  3. Environmental Regulation • Flexible 316(b) rule for cooling water intake structures • EPA re-proposed NSPS for GHGs for new coal plants: BACT=CCS • EPA seeking guidance for existing plants for proposed rule in 2015

  4. Public Power Business Model • Final JOT recommendations to Energy Secretary much improved • Tax-exempt financing: Terry-Neale House resolution (House Res. 112) gaining momentum with over 90 supporters

  5. Generation and Transmission • Hydro bills signed into law • Public Power Risk Management Act (H.R. 1038) creates an end user exemption for energy transactions • Working with industry on DG rate and interconnection issues

  6. Cyber Security/Reliability • House passed CISPA, voluntary information sharing bill • Worked with DOE, DHS, and NERC to form a new ESCC to improve government-industry coordination during national disasters

  7. RTO Mandatory Capacity Markets • FERC approved PJM settlement that restores self-supply exemption for public power and co-ops • FERC declined to approve a MISO mandatory capacity market • FERC technical conference on capacity markets

  8. Public Power Business Model • Locally owned and controlled • Strong customer focus • Competitive cost structure • Not for profit • Emphasis on reliable service

  9. Local Control/Governance • Local control is our greatest strength, or weakness • APPA expanding its offerings for members: flexible policymakers certification course • Updated Model City Charter available in APPA product store

  11. Competitive Cost Structure • Top priorities for 2013 include: • Federal PMAs • Tax-Exempt Financing • Industry Regulation

  12. Reliable Service • RP3 program continues to grow • New tools: eReliability Tracker • Emphasis on Mutual Aid: new list serve and Mutual Aid Task Force • Working with government-industry coalition to enhance response to national disasters
