D.C. Minimum Wage Laws • As of July 1, 2018, the minimum wage is $13.25 per hour. All industries are expected to comply. • Under the Fair Shot Minimum Wage Amendment Act of 2016, minimum wage will increase to $14.00 per hour on July 1, 2019 and $15.00 per hour on July 1, 2020. • Minimum wage will then increase each following year starting in 2021 in proportion to the increase in the Consumer Price Index.
D.C Sick and Safe Leave Policy • All employers in the District of Columbia must provide paid leave to each employee, including employees of restaurants, bars, temporary, staffing firms and part-time employees. • Paid leave accrues at the beginning of employment • Under the Accrued Sick and Safe Leave Act of 2008, accrued paid sick leave carries over from year to year. • Employers do not have to pay employees for unused paid sick leave upon termination or resignation of employment.
Maryland Minimum Wage Laws • As of July 1, 2018, state minimum wage is $10.10 • Montgomery County: $12.25 for employers with 51 or more employees and $12.00 for employers with 50 or fewer employees • Employees under 20 years of age must earn at least 85% of the State Minimum Wage Rate for the first 6 months of employment.
Maryland Sick and Safe Leave Policy • The Maryland Healthy Working Families Act requires employers with 15 or more employees to provide paid sick and safe leave for certain employees. • Paid leave rate is at least one hour for every 30 hours the employee works. • An employee cannot earn more than 40 hours of sick and safe leave in a year or accrue more than 64 hours of sick and safe leave at any time.
Delaware Minimum Wage Laws • Under Title 19, minimum wage has increased to $8.75 per hour as of January 1, 2019. • Minimum wage is due to increase on October 1, 2019 to $9.25 per hour. • Full-time high school or college students who work part-time may be paid 85% of the Delaware minimum wage (as little as $7.44 per hour) for up to 20 hours of work per week at certain employers (such as work-study programs at universities).
Delaware Sick and Safe Leave Policy • In Delaware, employers are not required to provide employees with sick leave, either paid or unpaid. • If an employer chooses to provide sick leave benefits, it must comply with the terms of its established policy or employment contract. • An employer in Delaware may be required to provide an employee unpaid sick leave in accordance with the Family and Medical Leave Act or other federal laws.
