Which Rules Apply ?What events require compliance • Only events where the pilot or operator is carrying passengers on sightseeing or just fun rides at a Charitable, Nonprofit or Community event. • Search and Location operations remain unchanged whereby only expenses and or rental may be reimbursed. However has to be under control of Local, State or Federal agency ; or Organization that conducts search and location operations. ( Locally : Texas EquuSearch )
91.146 : For Charitable, nonprofit and community events allowing them to continue without having to comply with FAA drug and alcohol testing requirements, and, raising the minimum hours for pilots from 200 – 500 and limiting the number of events permitted per year to 4 and 1 respectively • 91.147: National Air tour Safety Standards Final Rule . Effective 15 March 2007. Each operator conducting nonstop commercial flights within a 25 mile radius of an airport must obtain LOA from FAA by 11 Sept 2007
The New Regulations61.113 (d) Private Pilot • A private Pilot may act as pilot in command of a charitable, nonprofit, or community event flight described in $91.146, if the sponsor and pilot comply with the requirements of $91.146
How to Apply for Letter of Authorization • Send letter to Local FSDO 91.147(b) • Include the following: • List all requirements of 91.147(c) • Enroll and register in a DOT approved Drug and Alcohol testing program and implement same ( If commercial operations ) ** • Await LOA from FSDO
What to Expect once LOA has been Issued • Aircraft inspection for compliance on all aircraft registered on LOA • Facility inspection for compliance • Ramp Checks during operations • Random D&A testing of all Pilots in accordance with D&A Program

Please find attached the following images documenting the rectification of the following discrepancies : • As the original e- mail was too large to send , each of the discrepancies will be send independently in three (3) e-mails. • I would be grateful if you would confirm safe receipt of all three e mail transmissions. • 1 the new fuel placards and labels, • 2 the fire extinguisher service and 3 the replacement ASI in accordance with the POH on the front passenger seat panel.

Ted’s Commentary • The FSDO were very receptive to the application and did everything they could to follow through and assist. • There were no standard forms to complete for the application which made it somewhat unique, however, simply read the regulations and submit the application using the same language in the FAR’s • Follow up on the discrepancies by e-mail was rapid and resulted in a satisfactory conclusion. • The whole idea of this rule was to allow low key (non 135 0r Scheduled airline ) passenger carrying operations (for sightseeing ) to be permitted albeit increasing the pilot hours and restrictions on private pilots. • (Remember when you had 200 hours !! I think I agree !)
