  2. The Social Justice Coalition (SJC) is a democratic, public benefit, membership-based social movement. The majority of our members are working-class and poor individuals, most of who live in the informal settlements of Khayelitsha in Cape Town. The SJC has more than 2,000 members in 12 branches in Khayelitsha including RR1 Section, RR Nyanga, BM Section, BT Section, CT Section, SST, PJS, Nkanini, Green Point, Makhaza, Monwabisi Park and Zwezwe. In March this year the SJC, represented by the Legal Resource Centre (LRC), along with our partner organisation Equal Education (EE) launched an application in terms of the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 against the Minister of Police and acting National Commissioner on the issue of the allocation of police resources. Our court application aims to compel the South African Police Service (SAPS) to review and change the inequitable and irrational allocation of police resources in poor and working class areas. The Nyanga Community Police Forum (Nyanga CPF) has since been given leave to intervene and is now the third applicant in the case. Social Justice Coalition

Report of the Portfolio Committee of Police on Oversight visits to Police Stations in Nyanga and Philippi in the Western Cape Province, dated 31 October 2014 • The [Nyanga] station has 63 detectives and 7 are deployed elsewhere in units outside the station. The detectives are stationed at the Group 40 building in Eiseleben Road which is about three kilometres from the station, due to space constraints. • Detectives carry a docket load of 9000 with each detective investigating about 200 dockets. The detective carrying the least number of dockets is 45 (which is gang task team member) and the detective carrying the most dockets is 600. • Recommendations: • Of concern to the Committee was the staff shortage at the station, especially the detectives. The Committee recommended that the matter be addressed by the provincial management and make available additional staff to the station. Social Justice Coalition

  10. “The continued decrease in the incidence of sexual offences [3,2%] is a gratifying achievement.”…“The incidence of crimes against women in 2015/2016 increased by 2,15% when compared with 2014/2015. The breakdown of this increase points to certain areas of concern as murder increased by 8,15%, common assault by 4,03%, assault Grievous Bodily Harm (GBH) increased 1,64%.   14. 35% of the actual reported performance for the performance indicator “Stolen/lost firearms recovered in relation to the number of firearms reported stolen/lost”, was not reliable when compared to the source information or evidence provided. This was due to lost and recovered firearms not circulated on the Enhanced Firearm Registration System (EFRS) as lost or recovered. This was due to lack of monitoring of the completeness of reported actual achievements. 48% of the actual reported performance for the performance indicator “Stolen/lost state-owned firearms recovered in relation to the number of firearms reported stolen/lost”, was not reliable when compared to the source information or evidence provided. This was due to the late circulation of lost and recovered firearms on the Enhanced Firearm Registration System (EFRS) which resulted in reporting losses of firearms in the wrong period. This was due to a lack of frequent review of the validity of reported achievements against source documentation. Social Justice Coalition 16

To conclude: • Weltevreden (Nyanga) 3+ years Site Clearance failure needs to be interrogated, especially in light of discriminatory allocation of human resources • The truth about the incidence of sexual offences needs to be articulated. A lack of trust or confidence in the criminal justice system cannot be labeled a “gratifying achievement.” • The Waymark debacle must now be dealt with decisively and the Enhanced Firearm Registration System challenges need to be addressed.
