Design/Build Selection Process • Governed by Section 133.2 of City Policies and Procedures and Chapter 287.055 of Florida Statutes (Consultants’ Competitive Negotiation Act). • Request for Proposals statement is issued by City, describing services being solicited. • Respondents submit a qualifications based proposal to City for review. Although construction cost estimate was included in solicitation, no pricing was requested as part of the proposal. • Statements are reviewed by a selection committee of five city staff members.

Design/Build Selection Process • Selection is a qualifications based process – state law and City policy require staff to select the highest qualified firm or firms. • Highest qualified firm is determined through initial short-listing of proposals; short-listing is accomplished through a scoring matrix setting forth the selection criteria • Short-listed firms advance to oral interviews, then are ranked through use of a second scoring matrix. Note: the scoring and ranking from short-listing is not used in the final ranking determination.

Design/Build Selection Process • Solicitation in question was for design/build services to refurbish the Lake Eola fountain • Selection committee consisted of: • Lisa Early, Director, Families, Parks, and Recreation Department • John Perrone, Parks Division Manager • Carline Aliotte, Contract Compliance Investigator I, MWBE Office • David Dunn, acting Facilities Division Manager • Richard Forbes, Planner III, City Planning • Steve Wiedenbeck served as non-voting chair and facilitator for the selection process

Design/Build Selection Process • Solicitation was issued on February 14, 2010 to select a single firm to design and build the fountain improvements • City received 6 proposals on March 16, 2010 • The Consultants Qualification Board disqualified two of the proposers for failing to submit information regarding the design professional on their team • Selection committee met on March 24, 2010 to short list firms for the oral interview and decided on the following three firms: • Biscayne/ADE Joint Venture • Freeport Fountains, Inc. • Wesco Fountains

Design/Build Selection Process • Short listed firms were interviewed on April 12, 2010 • Proposing teams were given 30 minutes to present their qualifications and approach to the refurbishment; the selection committee reserved 20 minutes for questions • Following interviews, selection committee scored each firm using the Evaluation Criteria form included in the RFP solicitation • Resulting ranking was: 1. Freeport Fountains, Inc. 2. Biscayne/ADE Joint Venture 3. Wesco Fountains

Appeal Process • A firm wishing to appeal the ranking must notify the Public Works Director • If the Public Works Director denies the appeal, the next step in the process is to appeal to the Chief Administrative Officer (CAO) • If the CAO denies the appeal, the next step is a hearing before Council • The appellant will have 10 minutes to present the reasons for their appeal and state the action requested of Council • Staff will follow with a discussion of the appeal review conducted by the Public Works Director and Deputy CAO

Actions Available to Council Upon conclusion of the hearing, council may: • Deny the appeal - Move to approve Agenda Item NB 3 • Uphold the appeal and remand to the selection committee with instructions - Do not approve Agenda Item NB 3 • Deny the appeal and cancel the current RFP process; staff will reissue an RFP to start a new selection process - Do not approve Agenda Item NB 3
