Integrated Licensing Process (ILP) • On September 22, 2008, Sabine River Authorities filed a Notice of Intent (NOI) to use the ILP and Pre-Application Documents (PAD)
Benefits of ILP • Improves efficiency by requiring: • Pre-Application Document (PAD) • Early FERC staff involvement • Early NEPA Scoping • Process plan & schedule • Early study plan development & informal/formal dispute resolution

Prefiling 1 year 1-2 years • Commission staff conducts scoping meetings to identify issues of concern • Define process plan and schedule • Parties submit comments and Study Requests • Scoping Document 2 issued, as appropriate
Study Request Criteria • Describe goals and objectives of study proposal • Explain relevant resource management goals • Explain relevant public interest if requester is not a resource agency • Describe any existing information • Nexus to project operations and effects and how study results would inform development of license requirements • Methodology consistent with accepted practice • Consideration of level of effort and cost and why alternative studies would not suffice

NOI/PAD 9/22/2008 Prefiling 1 year 1-2 years • Applicants prepare Proposed Study Plans • Parties meet to discuss studies and resolve issues • Applicants submit Revised Study Plan • FERC staff issues Study Plan Determination
Conduct Studies & Prepare Application Studies/ Application Dev.2010-2011 Scoping/ Process Plan 11/13/2008-1/20/2009 Study Plan Dev. 3/6/2009-8/3/2009 NOI/PAD 9/22/2008 Prefiling 1 year 1-2 years • Applicants conduct studies • Applicants file study reports and parties review studies each year • Applicants prepare Preliminary Licensing Proposals (PLP)
Preliminary Licensing Proposals • Preliminary Licensing Proposals are due 150 days prior to license application due date (no later than May 3, 2011) • Existing and proposed facilities, operation, and environmental measures • Draft environmental analysis • Draft license applications (optional) • Draft BA (if necessary) and Historic Properties Management Plan • Comments on proposal due within 90 days
