How The MOT Disciplinary Process Works The MOT is a quick test for major problems and won't examine the mechanical condition of your car. It does not check the engine, clutch, or gearbox. The Case Review Team deals with all cases against Nominated Testers and Authorized Examiners. They also investigate complaints received from the public. Whenever any vehicle is involved in an accident which is reported to the police, the MOT tester of that vehicle has to report to CRT within 14 days of the incident. MOT Training Course - Disciplinary Process ●If your DVSA test shows an incorrect pass or fail result, you should take it back for a reexamination. ●When a customer pays an NT to have a car inspected, they must submit the car for a ‘mystery shopper’ to check. The purpose of this is to test the NT’s methods as well as their standards. ●A test in which a defective car was left at the VTS and picked up later that day for NTs to examine their methods and/or standards ●DVSA are more likely to investigate sites offering MOT tests if they suspect there are significant abuses of them. What happens during a disciplinary investigation? Once the file is submitted to the CRT, it goes through a careful review. If it meets criteria, the CRT will issue a contemplated disciplinary letter with details of the shortcomings of the case. It will ask for representations within 15 days of receipt. When a DVSA audit finds a shortcoming, a formal written response can be submitted. The individual can submit the response, or they can choose to use a trade body or association, consultant or solicitor. Outcomes Once a representation period is over, a case officer will consider the evidence and make a decision. The decision will be based on any documentation or instructions from material testing manuals, such as the MOT Inspection Manual. Decisions are made by following administrative law. For some offences, individuals may be prohibited from working for a certain period of time. This could be 2 years for NTs and 5 years for AEs.
