Common Terminology • Chain Restaurants: 20 or more facilities in California under the same ownership or franchise with substantially similar menu items. • Standard Menu Item: Items offered for sale for more than 180 day per calendar year. • Point of Sale: Location where order is taken • Quick Service: Orders are placed at service counter (e.g. Taco Bell). • Table Service: Orders are placed with wait staff at a table (e.g. Cheesecake Factory).
Does a Facility Qualify? • SB 1420 pertains only to chainrestaurants with 20 or more facilities in California. • Chainfacilities have been identified on your Envision report. • Exempt Facilities • CFM’s, convenience & grocery stores, LHCF’s, school cafeterias, MFSU’s, self service buffets, pharmacies, and vending machines. • Note: Separately owned food facilities within grocery stores (e.g. AFC Sushi) are not exempt.
Main Provisions: Table Service • Beginning July 1, 2009 Table Serviceestablishments must either: • Provide a brochure, menu, or menu insert at the dining table that discloses calories, carbohydrates, saturated fat, and sodium for each standard menu item, OR • Disclose calories only for each standard menu item on all menus, menu boards, or display tags in display cases.
Main Provisions: Quick Service • Beginning July 1, 2009 Quick Service establishments must either: • Provide a brochure at the point of sale that discloses calories, carbohydrates, saturated fat, and sodium for each standard menu item, OR • Disclose calories only for each standard menu item on all menus, menu boards, or display tags in display cases.
Main Provisions: January 1, 2011 • Beginning January 1, 2011 all establishments must: • Disclose calories only for each standard menu item on all menus, menu boards, or display tags in display cases.
Examples: Garlic Herb Chicken 370 calories Seasoned grilled chicken breast served in a garlic herb sauce. Paired with steamed herb potatoes and seasonal vegetables. $8.69 Calories
What About The Drive-through? • Beginning July 1, 2009 establishments with drive-through windows must: • Provide a brochure at the window that discloses calories, carbohydrates, saturated fat, and sodium for each standard menu item, AND • Display a conspicuous sign on the menu board that states: • “Nutritional Information Available on Request”
Combo & Customized Meals • Combo meals • Food facilities can specify a min to max calorie range for a combination of standard menu items. • Customized meals • Menu labeling only applies to standard menu items. Nutritional information must be provided for a gourmet veggie pizza but, not for a special order three topping pizza.
Foods That Are Exempt • Exemptions include: • Alcoholic beverages and self service drink stations. • Complimentary pre-meal items (e.g. salsa & chips). • Self service condiments. • Salads with dressing on the side.

Enforcement • Menu labeling violations • Violations are considered minor and shall be noted in box # 32 of the OIR “Food properly labeled and honestly presented”. • Law provides for fines of $50 to $500. • Enforcement agency shall check to see that nutritional information is provided and that the information was obtained by reasonable means.
In Summary • Beginning July 1, 2009 chainestablishments must: • Provide brochures with nutritional information where the order is taken, OR • List calories next to standard menu items on menus, menu boards, and display tags. • Beginning Jan 1, 2011: chainestablishments must: • List calories next to standard menu items on menus, menu boards, and display tags.
