Florida’s BART Program • Developed state BART rule • Adopts federal BART rule by reference, but adds a number of details like: • Permit requirements and application deadlines • Exemption criteria • BART = CAIR for EGU’s (PM review only) • VOC’s and ammonia not considered • Applications/Reports were due by Jan 31,2007

  3. BART-Eligible Sources • Florida has 47 BART-eligible sources • 4 are shutting down • 8 are going through a BART determination • 2 power, 4 phosphate, 1 paper, 1 cement • 35 are seeking exemption • 20 power, 3 phosphate, 4 paper, 4 sugar, 3 chemical, 1 gas plant

Tidbits • All 8 BART determinations propose no additional control (some fuel S reduction) • 1 proposed BART exempt source is reducing SO2 emissions by 3,300 tons per year to avoid the determination • 8 of the proposed exempt sources are only exempt with the new IMPROVE equation • 4 of the proposed exempt sources are by way of the model rule emissions/distance criteria • 3 are modifying permits to meet exemption criteria

  5. Process for Exemptions • Obtain EPA/FLM comments on exemption modeling • Access to all files through an ftp site for 30 days. We expect this to occur very soon. • After resolution of any comments, develop draft orders to sources accepting/rejecting exemption request • After 21 days, if no challenge, then order final

  6. Process for Determinations • Review currently in progress • Completion anticipated by mid summer?

  7. Reasonable Further Progress • Propose state RFP rule requiring selected sources to submit a four-factor analysis through the permitting process • Selection of sources will be based on “area of influence” analysis completed by VISTAS. • Regional Haze SIP (due in Dec. 07) would contain rule with schedule for completion.
