  2. Focus Questions • What views did Thomas Jefferson express about political parties in his inaugural address? • What Republican policies did Jefferson introduce, and which Federalist policies did he accept? • Why was Marbury v. Madison an important court case?

  3. The Republican Victory • Thomas Jefferson had a large crowd attend his inauguration but John Adams was absent • The Democratic-Republicans not only won the presidency but also won a majority in Congress • Many looked at this change of government as a triumph of democracy • In his inaugural address Jefferson spoke about the will of the majority and eased the Federalists by insisting that he was going to run a fair government

Jefferson in Office • Jefferson lowered military spending and the hope that he could cut the national debt • Jefferson also wanted to get rid of domestic taxes (like the tax on whiskey) • Jefferson allowed the Bank of the United States to remain open (federalist program) • Jefferson eventually replaced many Democratic-Republican officials in government with Federalists (did not get rid of all of them)

  5. Marbury v. Madison • Before Jefferson took office, Federalists in Congress passed new laws that created many new judgeships • Adams put in dozens of judges that were Federalists • When Jefferson took office some of the judges chosen by Adams had not had paper work filed to complete the process • Jefferson came into office and ordered his secretary of state James Madison to not file the papers

  6. Marbury v. Madison • William Marbury was one such judge that did not get their judgeship position • He wanted the Supreme Court to force Madison to file the paper work • John Marshall was the chief justice and a federalist of the Supreme Court at that time and agreed to hear the case

  7. Marbury v. Madison • The Supreme Court decided that the they did not have the power to force Madison to file the paper work • They also found that a portion of the Judiciary Act of 1789 was unconstitutional

  8. Marbury v. Madison • This ruling established judicial review– allows the Supreme Court to an act of Congress unconstitutional • The law then is no longer in force • This GREATLY increased the Supreme Court’s legal authority
