1st Amendment • Freedom of: • Religion • Separation of church and state • Speech • Limits – cannot cause physical harm to others • written defamation - libel • spoken defamation – slander • Any act of free speech that can be linked to an unlawful action
1st Amendment • Press • May not spread libel • Assembly • Peaceably • Petition • Redress of grievances (address your concerns) • Contact representatives
Bill of RightsProtecting citizens • 2nd - Right to bear arms • 3rd – quartering troops w/out permission • 9th - States that not all rights are listed in the Constitution • 10th - responsibility of the states to protect citizens’ rights
Rights of the Accused • 4th - Protection from unreasonable search and seizure of private property unless a warrant was granted by a judge • 5th – • Before being tried a person must be indicted • Self-incrimination – testifying against yourself • Right to a fair trial and due process of law • Double jeopardy • right to own property-eminent domain • 6th – • Prompt and public trial decided by a jury • Informed of the charges • Right of the accused to a have a lawyer
Continued • 7th – trial by jury in cases involving $/property • 8th – • Forbids cruel and unusual punishment • setting excessive bail
Rights of States and Citizens • 9th - To protect rights not listed in the BofR • Ex.: Political activity and right to privacy • 10th - responsibility of the states to protect and act independently of the federal gov. to citizens’ rights
