    2. General Considerations For every crime committed, there are a set of elements that define the crime. In order for a person to be convicted of the crime, it must be proven that every element of the crime was committed; and that the person was in a criminal state of mind, if necessary. The elements of the crime are pretty basic, for example, an element of murder would be the killing of the person.
