S53X Scope • Site legal address is 140 – 204 Western Ave • A private landholding & separate from the Landfill • Two independent processes (i) Rezoning is regulated under Planning Act, (ii) Contamination Assessment is regulated under the Environment Protection Act • S53X Audit is the most rigorous method under the regulations for assessing exposure risks to future users & was completed voluntarily by Transpacific • Soil, groundwater & air segments of environment at the site were assessed
S53X Finding • 140 – 204 Western Ave is suitable for commercial land use (subject to the relevant planning approvals). • The finding is conditioned : • Groundwater boreholes must be accessible for sampling by Transpacific; • Groundwater use is limited; • Any licence application for groundwater abstractions is referred to the Auditor for review by Southern Rural Water.
S53X Limitations • The Auditor’s statement is issued under the Environmental Protection Act 1970 • Auditor findings cannot be changed • The Auditor’s statement will inform the Planning process • Tonight’s meeting is to provide information and clarification
