Nor will TPSAC be responsible for loss of or damage to, or loss of use of the Facility by the User or others from any cause, whether or not it results from any negligent act or omission of the TPSAC. TPSAC is not responsible or liable for damage caused by other users or occupants of the Facility or by occupants or users of property adjacent to the Facility, or by the public or any other entrants to the Facility, whether authorized or unauthorized. Indemnity - The User will indemnify TPSAC and save them harmless, and release TPASC and each of its elected officials, TPASC Board members, employees, officers, servants and agents, from and against all actions, suits, claims, executions, proceedings, demands, which may be brought or made upon TPASC, in respect of any costs (including reasonable legal fees), expenses, loss, damage or injury (including death), occasioned wholly or in part by any negligence or acts or omissions by the User, their officers, agents, employees, volunteers or others for whom they are responsible at law, arising out of any cause whatsoever, either direct or indirect, through its use of the Facility, or in connection with this User Agreement. Property Brought into Facility - TPASC is not responsible for any property or items brought into or onto the Facility at any time. Conduct of Users - The User shall be responsible for the conduct and supervision of all persons admitted to the Facility and surrounding area, including parking areas, in connection with this User Agreement and shall see that all obligations contained in this User Agreement are strictly observed. The User is responsible to ensure that all participants in evening events leave the Facility and surrounding areas, including parking areas in a prompt and quiet manner so as to minimize noise and other annoyances to nearby residents. Vandalism, littering or the use of abusive language on or near the Facility shall be just cause to cancel this User Agreement and/or deny further User Agreements. Individuals who violate TPASC conduct policies will be asked to leave the premises and can be denied access to the centre at the discretion of TPASC. Alcohol - The facility of TPASC is a licensed facility. No alcohol shall be brought in from outside sources or consumed in locker/change rooms/field of play. TPASC Privacy Policy - TPASC is committed to protecting the personal information of all users by following best practices. The collection of personal information will be gathered to better serve our clientele and to also ensure the safety of all TPASC users. Information gathering will relate to registration and payment, program delivery, and to fulfill regulatory obligations. Use of Likeness for Promotional Purposes – The user shall consent to the use by TPASC of its team(s) in photographs, videos and new media, and the user acknowledges and agree that TPASC reserves the sole and exclusive right to use any such photographs or videos for advertising and instructional purposes, without cost or charge to TPASC.
