Overview of Phase II Stormwater Permit Process • State issued permit • Permit requires Mint Hill to adopt a “post-construction ordinance” by July 1, 2007 • Permit requires stormwater plans to incorporate any site specific management plans • Environmental group contested the permit • ALJ and EMC Committee concluded… • The permit was inadequate to protect the Carolina Heelsplitter Mussel, and • Should provide for more extensive buffers while the Site-Specific Management Plan is prepared • State will have to issue a new Stormwater Permit
Overview of Site Specific Management Plan Process • Discussion has been “off-line” for several years • Formal process is just beginning • Expect a draft of the new rule with possible 50’ buffers from state staff in spring 2007 • Public notice & public hearing period • Opportunity for Town and citizens to be heard and influence the process and results.
Next steps for the Town • Review the revised Stormwater Permit, provide comments to the state and consider whether any legal action is appropriate, • Adopt a post-construction ordinance consistent with the revised Stormwater Permit by June 30, 2007, • Get involved in the upcoming Site-Specific Management Plan (a/k/a Heelsplitter Protection Plan) public input process, • Monitor the status of the IBT permit
