The Ministry for the Environment, The EPA and the Opportunities for engagement New Zealand Agricultural Aviation Association Conference 2010
The Context The last chapter of a book is meaningless without the story that precedes it.
The Environment… • Part of our identity • Resources and Tourism - $50 Billion
It’s our brand New Zealand was a friend to Middle Earth, but it's no friend of the earth 12 November 2009 Lord of the Rings country trades on its natural beauty, but emissions have risen 22% since it signed up to Kyoto As the world prepares for the next month, it is worth checking out the greenwash that has followed the promises made at • Guardian newspaper UK …but it’s under attack
The Ministry for the Environment • Established in 1986 • Advisor to government on • administration and management of natural and physical resources and ecosystems (including allocation) • Public participation in environmental policy and planning at the local level • Pollution, hazards, and environmental impacts • Resource Management Act, Waste Minimisation Act, Climate Change Response Act
Role of the Ministry • Not involved in day-to-day environmental management, the focus is on: • Laws, regulations and national environmental standards • Providing national direction through national policy statements and strategies • Providing guidance for the implementation of legislation • Monitoring and providing information about the health of the environment
NZ EPA – Current model • Administers nationally significant RMA consents • NZ EPA - a unique model established 2009
NZ EPA – types of projects New power stations – such as the Tauhara Stage 2 geothermal plant New motorways such as Transmission Gully
EPA – From July 2011 • Administration of processes for nationally significant projects • Emissions trading scheme administration • Hazardous substances & new organisms (ERMA) National level policy National level implementation Environmental Protection Authority Ministry for the Environment Local Councils Local, day-to-day policy and implementation
The Opportunities • You have an ability to influence the regulations that will impact on you • Rules that are inappropriately targeted or which can not be easily understood mean • More time studying the regulations = less time in the cockpit = less $$ • Compliance and enforcement costs = less $$
Engagement – Levels Central Government Policy Central Government Implementation “Class G” Airspace Local Government Policy Development Local Government Plan Submissions (Traditional levels of engagement) “Class C” Airspace Local Government Implementation Local Government Compliance and Enforcement Restricted Area
Engaging in policy • Need to talk the same language - get a common understanding • Arriving with a solution will get a more positive response than arriving with a problem CAA Regs, Vne, indicated airspeed, VFR, IFR, type rating, class G airspace, QNH, dead reckoning?? Permitted baseline ultra vires, RMA, section 32, consent conditions, section 88(3), notification??
Key Points • It is a time of change for environmental management • The new EPA is an opportunity, not a threat • Be proactive - It is easier to influence policy before it is written • How you engage with policy makers, and at what level, is up to you
