Federal VAWA 2005 • VAWA 2005 (VAWA III) most recent enactment of a series of federal laws designed to improve services and responses to VAW. • VAWA III further expands system responses to DV, dating violence, sexual assault and stalking. • VAWA III incorporates preventive, outreach, and community-based services for survivors and their families.

  12. VAWA III Court Programs • Funding for court programs designed to address DV, dating violence, sexual assault and stalking; development of national training curriculum for court and court- related personnel on these issues.

  13. VAWA III amends full faith and credit provisions of federal law to restrict information a court can make available electronically about victims. No internet information about the registration, filing of a petition for, or issuance of a protection order if publication reveals the ID or location of a victim. What effect does VAWA III have on Prothonotaries?

  14. 18 USC §2265 • A State…shall not make available publicly on the Internet any information regarding the registration, filing of a petition for, or issuance of a protection order…if such publication would be likely to publicly reveal the ID or location of the party protected under such order. • A State …may share court-generated and law enforcement-generated information contained in secure, governmental registries for protection order enforcement purposes.

  15. AOPC’s Electronic Case Record Public Access Policy issued on January 1, 2007 Sets forth parameters for public access and inspection of electronic case records. Provides that victim information including name, address and other contact information in an electronic record is not accessible by the public. Applies to CPCMS, MDJS and PACMS only.
