  5. Board of County Commissioners Action Requested • Approve the Bent Oak Industrial Park Preliminary Subdivision Plan dated “Received June 30, 2011,” subject to the twelve (12) conditions in the staff report.

Board of County Commissioners Project : ILH Interchange Center PD/LUP Substantial Change Applicant:Rick Ortiz District #: 1 Request: To consider a substantial change to the approved ILH Interchange Center Planned Development/ Land Use Plan (PD/LUP) to allow for waivers from Section 38-1287 (2), (3), and (4) to allow for an internal lot line building setback of 0 feet in lieu of 30 feet, a side setback of 0 feet in lieu of 20 feet, and a side and rear paving setback, on interior lot lines only, of 0 feet in lieu of 7.5 feet. No additional entitlements are being sought as part of this request.

Board of County Commissioners Comprehensive Plan • FLU8.7.5 and PS5.2.1 • Both state that, “…Public elementary schools, middle schools, and free-standing ninth-grade centers shall be allowed as special exceptions in the following land use categories located in the Rural Settlement Areas: 1/1, 1/2, 1/5, Low Density Residential, Low-Medium Density Residential, and Institutional. In addition to the locations identified above, public elementary schools, middle schools and free-standing ninth-grade centers shall be allowed as a permitted use in all future land use categories if identified in a Planned Development Land Use Plan approved by the Board of County Commissioners.”

Board of County Commissioners Comprehensive Plan • FLU8.7.1 • Requires that the County “…support and encourage the location of new elementary and middle schools, unless otherwise required, internal to residential neighborhoods.” • Objective PS5.2 • Requires the County to clearly identify the land use categories in which schools shall be an allowable use. As mentioned above, in both the Comprehensive Plan (Policies FLU8.7.5 and PS5.2.1) and the School Siting Ordinance (Ordinance 96-31), elementary schools are allowed in Rural Settlements if approved as a Planned Development (PD).

  17. Board of County Commissioners Interlocal Agreement The school site lies within two jurisdictions. OCPS, Orange County, and the City of Ocoee have worked cooperatively to establish a tri-party interlocal agreement to ensure the timely and efficient construction of the school on this site. The 19-E-N-7 Hackney Prairie Road Area Relief School Site Tri-Party Agreement (Agreement) establishes provisions for offsite improvements, development review procedures, zoning, public meetings, utilities, and drainage improvements.
