Challenges - Technical Project Not Technically Challenging, but: • Operational railway • Changing Standards / Regulations • Changing Technology • Adjacent River (Maritza) / High water table • Interfacing between contracts / other stakeholders • Materials supply • Design / Build Philosophy • Consider construction technology • Manage the process (invest in this)
Structures Phase 3 – Time Saving Solution (Design / Build ‘Innovation’)
Challenges - Contractors • Late, inadequate, mobilisation • Insufficient understanding of the market • Insufficient experienced resources (cost cutting) • Inadequate ‘ownership’ of designer / sub-contractor inputs • Contractor required to ‘Manage’ the process, • Contractor required to manage to programme (invest in this ) • Low bids
Challenges - Culture • Foreign / Local understanding each other • Respect? • Decision making • Delegated Authority • Responsibility / Accountability • Appreciation of ‘urgency’ • Authorities • Municipalities • Planning – Foresight – not ‘Firefighting’ • Safety • Employer
Challenges – Legal • Territorial Arrangement Act • Construction Permits • Act 15/ 16 • Public Procurement Act • Change Management – Art 90 • Change is Difficult • Law of Contracts and Obligations • Contract operates within this • Good Faith • NRIC Regulations
Challenges – Financial • Competitive Tenders • Contractors’ / Consultants’ Risk! • Change? – See Public Procurement Act • Cashflow • Advance Payment • Payment Terms – As Contract
Example Risks • Land Acquisition • Trees • Archaeology • Municipalities • Roads Agency – Junction Tie-ins • Interoperability • Accessibility (Ramps if Possible) • Environmental
Project Summary • Difficult project • First of its size and complexity in modern times in Bulgaria • Approx 80Km (55%) of total Plov-Svil railway (track) is implemented • Many lessons being learnt by many stakeholders • Positive inputs for the future development of the railways in Bulgaria • Project primary objectives – will be met • Still some way to go….
Recommendations? General Observations • Thorough pre-planning is essential – all stages • Invest in design / investigation – all stages • Engage Municipalities / Roads Agency early • Recommend Standard Contract Documents (Eg. FIDIC) – Apportion risks fairly, certainty • Training of stakeholders • Consider modification to the legal framework for such projects? • Consider implementation of ‘Lessons Learnt’
