  2. FY 2013 Funding • FY 2013 -- October 1, 2012 • No Appropriation at this time • Long-term CR • Initial Payment rate 45% of LOT

  3. FY 2013 -- Scenario #1 • Congress Appropriates Full Year Funding by December 31 • Increase LOT% payment rate • Release interim payments in January and February • Interim LOT% rate will be less than in previous years – APPE increase

  4. FY 2013 -- Scenario #2 • Congress appropriates in February or March 2013 • No interim payments until March or April

  5. FY 2013 -- Scenario #3 • Sequester January 2, 2013 • Reductions of 8-9% • Sequester reduces interim and final payment rates

  7. Impact Aid For Indian Children • Over 600 School Districts with Indian children receive Impact Aid • On behalf of over 115,000 children living on Indian lands • $500+ million each year

  8. “Indian Policies and Procedures”Local Education Agency Requirements LEAs that receive Impact Aid payments for children living on Indian lands must consult with tribal officials and parents of Indian children about the education program of the school district.

  9. Local Education Agency Responsibilities • Disseminate the Impact Aid Program application to tribal officials and Indian parents. • Disseminate information on any education programs that the LEA plans to initiate or eliminate and any evaluations of education programs supported by Impact Aid funds.

  10. Local Education Agency Responsibilities • Consult and involve tribal officials and Indian parents in the planning and development of education programs and activities supported by Impact Aid funds

  11. Local Education Agency Responsibilities • Provide an opportunity for tribal officials and Indian parents to comment on the participation of Indian children on an equal basis with all other children in the school programs and activities supported by Impact Aid funds.

  12. Local Education Agency Responsibilities • Modify the education program, if necessary, to ensure the equal participation of Indian children.

  13. Local Education Agency Responsibilities • Afford tribal officials and parents of Indian children an opportunity to make recommendations concerning the needs of their children and how the schools can help their children benefit from the education programs assisted with Impact Aid funds.

  14. Local Education Agency Responsibilities • Provide an opportunity for tribal officials and Indian parents to present their overall views on the education program and the degree of parental participation allowed.

Suggestions for Good Quality Consultation • Open, Early and Often • Parties Must Be Present • Focus on Content-- • State standards and assessments • Achievement of Indian children in relation to State standards • Curriculum choices • Unique educational and cultural needs of Indian children • Professional development linked to educational needs of Indian children
