Permit Process: • Local Jurisdiction (Kitsap County) • Washington Department of Fish and Wildlife • Army Corps (if at or below Mean High Water)
WAC Guidelines [WAC 173-26-231(3)(a)] • Shoreline Stabilization • New development should be located to avoid need • New structural stabilization shall not be allowed except: • when necessary to protect existing primary structures • for new and existing development under specific conditions • ecological restoration projects, when determined necessary • Geotechnical reports must address time frame (3 years) • Must consider soft shoreline stabilization measures • When allowed, must be at or near Ordinary High Water Mark, replacements included.
Issues: • New Bulkheads • Repair and Replacement • Appurtenance Protection • Incentives
Breakwaters, Jetties, Groins, and Weirs • Only allowed where necessary to protect water dependent uses, public access, shoreline stabilization, or other specific public purpose. • Require a Conditional Use Permit, except where installed to protect or restore ecological functions • Provide for mitigation [WAC 173-26-201(2)(e)]
