  8. SET A TONE FOR YOUR CLIENT • FOCUS ON THE ISSUES, NOT THE PEOPLE • REFRAIN FROM MAKING INFLAMMATORY STATEMENTS • MAINTAIN BALANCE, LOOK FOR COMMON GROUND

  9. SET A TONE FOR YOUR CLIENT • ENCOURAGE CLIENT TO PARTICIPATE FULLY • OBTAIN AND SHARE NEEDED DATA • USE THE MEDIATOR AS A COLLABORATOR

  10. STRATEGIES FOR PRACTITIONERS • Scheduling to allow all participants to be present. • Prepare a plan with your client that addresses how to proceed in mediation. • Establish acceptable range or outcomes.

  11. STRATEGIES FOR PRACTITIONERS • Identify factual, legal and non-legal issues. • Be willing to listen to the other side. • Be prepared to enter into an agreement on the day of mediation.
