CZ Legislation on Detergents Detergents = chemicals „Chemicals Act“ no. 356/2003 Coll. on chemical substances and chemical preparations, as amended • among others transposes the relevant EC regulations and in relation to the directly applicable regulations of the European Communities • stipulates the rights and obligations of legal persons operating a business • defines the competence of the administrative authorities in the protection of health and environment

  5. Regulation 648/2004/EC Article 18 of the Detergents Regulation requires • appropriate legal or administrative measures in order to deal with any infringement of this Regulation and • dissuasive, effective and proportionate sanctions for any such infringement

  6. Enforcement – legislation/control Ministry of the Environment competent authority pursuant to Article 8 (1) of theRegulation no. 648/2004/EC Czech Environmental Inspection • Controls how manufactures comply with Articles 9 and 11 of the Detergents Regulation • Imposes fines on manufacturers failing to comply with obligations laid down by the Regulation no.648/2004 • Prepares annual report on the controls performed and plans further controls

Management of Resources CEI oversees the enforcement of • Air protection • Waste management and chemical substances • Nature protection • Water protection • Forest protection Administrative arrangements • 10 regional Inspectorates and CEI headquarters • ca 600 staff, about 75% work as inspectors

Awareness raising + Time 2005 workshop for the detergent industry and academia preparation of methodology of controls, preliminary plan of controls, communication channels „internal helpdesk“, adaptation of the national legislation 2006 workshop for CEI inspectors on methodology and news in the Detergents Regulation pilot testing – schedule of controls + methodology 2007 working control mechanism in place

Methodology Legislation in force Scope of the inspection • biodegradability of surfactants • labelling of the detergents sold to the general public • Availability of the information (ingredients list) on the manufacturer‘s/distributor‘s website Reports to CEI database on the results and follow up Yearbook - Evaluation of results (MoE+CEI)+adaptation of measures/methodology Plan of controls Information database updates

Conclusions Factors to consider when working on the methodology of controls • scope of production in the country, resources available, availability of information Time factor when preparing enforcement measures Information sharing between decision makers and enforcement bodies Results of the controls in CZ - so far a good compliance with the Regulation 648/2004/EC observed.
