Introduction Amnesty International maintains that all people, regardless of their sexual orientation or gender identity, should have access to all human rights described in the Universal Declaration of Human Rights. Everyone has a sexual orientation and a gender identity. When someone's sexual orientation or gender identity does not conform to the majority they are often seen as a legitimate target for discrimination or abuse. Not only are millions of people across the globe facing execution, imprisonment, torture, violence and discrimination because of their sexual orientation or gender identity, but the very consideration of the issue is seen by many states as a threat to the core principle of the universality of human rights. Laws criminalizing homosexuality encourage the dehumanization of lesbians, gay men, bisexual people and transgender people (LGBT) as their very identity is criminalized.

    3. Some Helpful Explanations Transgender - People who were assigned a gender at birth, based on their genitals, but who feel that this is a false or incomplete description of themselves. This term includes transvestites, transsexuals, transgenderists, androgynists, and intersex people. Discrimination – When governments, institutions, or individuals treat people differently based on their personal characteristics – such as (but not limited to) sex, sexual orientation, gender identity, racial or ethnic identity, age, or health.

    4. A Brief History Transgenderism has been present throughout history in a variety of cultures and societies. Hijra of India Polynesian cultures- recognition of a third sex Native-American two spirit people- viewed as a gender role

    5. Crimes Against Transgendered & Transsexual People 29 States have laws that mention sexual orientation or Gender identity in their definitions of Hate Crimes. Some of the States include California, New Mexico, Pennsylvania, Vermont, Connecticut, Montana, Minnesota, and Hawaii.
