Core Requirements of the DAA Mobile Guidance • 1st & 3rd parties are required to provide the following across device: – Notice – Access to consumer controls • Enhanced Notice* and Prior Consent required if: – “Cross-app data” is collected from all, or substantially all, applications on a device. – “Precise location data” is collected and used by or transferred to 3rd parties. – “Personal directory data” is obtained or used. * “A clear, meaningful, and prominent link” 3
Situations with Heightened Requirements Precise Location & Personal Directory Data Cross-App Data: – Data collected on a particular device regarding application use over time and across non-Affiliate applications – First-party requirements for enhanced notice of collection – Third party also provides enhanced notice, choice – Precise Location Data: Data about the physical location of a device that is sufficiently precise to locate a specific individual or device – Personal Directory Data: Certain data (e.g. calendar, address book) created by a consumer that is stored on or accessed through a device – Authorization is required for first and third parties prior to collection and use 4
