Janata Dal (U) • "Janata Dal (U) is dedicated to the task of building up a democratic, secular and socialist State of India on Gandhian principles, inspiration from our rich heritage and the noble traditions of our struggle for national independence and individual liberty. The Party believes in a polity that ensures decentralization of economic and political power. It affirms the right of peaceful and democratic dissent, which includes satyagraha or non-violent resistance.“

AIMS AND OBJECTIVES To uphold the sovereignty and integrity of the Nation. To bring good governance through good laws and good people. To eradicate corruption by getting rid of causes that creates Corruption. To optimize utilization of our human and natural resources for improving quality of life for all citizens. To provide basic education, livelihood and quality healthcare to all citizens. To establish a system of ‘Affirmative Action’ for the betterment of the deserving sections of the society on economic criteria.
To establish equal opportunity for the upliftment of all citizens specially the economically weaker sections. To work for the adoption of an effective National population control policy in order to put an end to the Nation’s infinite problems. To follow independent Foreign Policy to make India globally strong. To put in place an effective and comprehensive national security policy to deal with the problem of Terrorism and cross-border infiltrations.
To work for the reformation of criminal justice system with emphasis on witness protection plan and speedy justice. To put an end to criminalization of politics and bring about electoral reforms. To secure the future of our youth by an effective education policy including character building and harness their potential to transform India into a World leader. To work for the introduction of new agricultural policy to bring prosperity to our farmers in order to make agriculture a profitable enterprise on which the majority of the Indian population is dependent. To create infrastructure on a time bound basis and generate mass employment opportunities and improve quality of life

To do all other consequential and incidental acts in order to bring about a positive change in the governance of the country
Membership Any person who is a citizen of India, has attained the age of 18 years, not convicted by a competent court of law in an offence involving moral turpitude, accepts the Constitution and the ideology of the Anti Corruption Cell Janta Dal (United) and is not a member of any political party or organization whose aims and objectives are in conflict with those of the Party can apply to become a “LIFE MEMBER’ / “REGULAR MEMBER” / ASSOCIATE MEMBER” / MEMBER or PRIMARY MEMBER of the ANTI CORRUPTION CELL by answering the estionnaire and filling up the application forms annexed herewith this Constitution. 5 The LIFE MEMBER will be required to pay a membership fee of Rs.11,000/- (Rupees eleven thousand only)
Membership • The REGULAR MEMBER will be required to pay a membership fee of Rs.1000/- (Rupees One Thousand only). Life Members and Regular Members will have the voting right as well as the • right to contest in any organizational election. • The ASSOCIATE/STUDENT MEMBER will be required to pay a fee of Rs.50/- (Rs. Fifty only). The PRIMARY MEMBER will be required to pay a fee of Rs.10/- (Rs.Ten only). • AssociateMember/Primary Member shall be enrolled only through a Member. • He/she will not have the voting right as well as the right to contest in any organizational election. • The Regular Members, Associate Members and Primary Members shall be • required to renew their membership periodically as prescribed.
Membership • The application for LIFE MEMBER, REGULAR MEMBER , ASSOCIATE or PRIMARY MEMBER shall be considered by the National President or his nominee's and only in the event of the same being granted, the applicant shall become the LIFE MEMBER, REGULAR MEMBER , ASSOCIATE MEMBER, STUDENT MEMBER or PRIMARY MEMBER. In case of rejection, the fee paid by the applicant shall be returned to him/her
Organizational Structure The organizational structure of the cell shall be three-tier, i.e., District Level, State Level and National Level. The District level unit shall be called District Council. It shall consist of 100 elected representatives, elected by the enrolled Life Members and Members of the party of that District from amongst themselves. The elected representatives of the District Council shall elect one amongst themselves to be the President of District Council and such elected President shall be the ex- officio President of the District Executive Committee and shall also be called the District President. The President shall nominate two Vice Presidents, one General Secretary, two Secretaries and a Treasurer from amongst the elected members of the District Council. All these functionaries would jointly constitute the seven-member District Executive Committee. The State level unit shall be called State Council. It shall consists of the Presidents and the other office bearers of all the District Executive Committees of that particular State. The members of the State Council shall elect one amongst themselves to be the President of the State Council and such elected President shall be the ex-officio President of the State Executive Committee and shall also be called the State President, who shall in turn nominate two Vice-Presidents, one General Secretary, two Secretaries and one Treasurer from amongst the elected members of the State Council. All these functionaries would jointly constitute the seven-member State Executive Committee.
Organizational Structure The functionaries of the State Executive Committee shall cease to be the functionaries of their respective District Executive Committees and the resultant vacancies shall be filled up as per the preceding clauses. The National level unit shall be called National Council. It shall consist of the following: • a) All the Presidents of the State Executive Committees • b) All the members of the Advisory Council. The members of the National Council shall elect one amongst themselves to be President of the National Council and such elected President shall be the ex-officio President of the National Executive Committee and shall also be called the National President. The National Council shall also elect from amongst themselves two Vice Presidents, one General Secretary, two secretaries, one Treasurer and 8 executive members. The National President along with all these functionaries would jointly constitute the fifteen member National Executive Committee.
Organizational Structure • The functionaries of the National Executive Committee including the National President shall cease to be the Presidents of the State Executive Committees, if they are elected from amongst the Presidents of the State Executive Committees as mentioned in preceding clause 7(a) and the resultant vacancies shall be filled up as per the preceding clauses. • The term of all the elected Units and functionaries shall be three years. • Till the first elections are held as per the provisions of the Constitution, Executive Committees at all the three levels as may be deemed expedient by him in consultation with the Advisory Council.
Advisory Council There shall be an Advisory Council comprising of not more than 100 persons including Sr. Advisors who have attained excellence in their respective fields. The members of the Advisory Council shall be nominated by the National Executive Committee. The members of the Advisory Council shall hold office for a period of one year unless they are re-nominated by the National Executive Committee. Till the first Advisory Council is constituted as per the provisions of this Constitution, the National President shall have full authority to constitute the same. The Advisory Council shall meet at least once in six months to review the overall functioning of the party and ensure that the various level bodies of the Party function in accordance with the stated aims and objects of the Party.
Removal The President of the District Executive Committee shall be removable by a vote of no confidence passed by two-thirds members of the District Council. The other office bearers of the District Executive Committee shall be removable by the District President after obtaining the approval of the State President. The above provision shall apply mutatis mutandis to the removal of the President and other office bearers of the State Executive Committee as well. The National President shall be removable by a vote of no confidence passed by two- thirds members of the National Council and other office bearers of the National Executive Committee shall be removable by the National President in consultation with the Advisory Council. The National President shall have the prerogative to intervene at any time in an extraordinary situation and to remove the Presidents and the office bearers of the State as well as District Executive Committees in consultation with the Advisory Council. The resultant vacancies whatsoever on removal shall be filled up in accordance with the preceding clauses.
Powers and Functions of the three-tier Executive Committees. • The District Executive Committees shall have the authority to take all decisions for the conduct of the affairs of the party at District level subject to the over-all superintendence of the respective State Executive Committees. • The above provisions shall apply mutatis mutandis to the State Executive Committees. • The residuary powers, particularly in the matters of policy decisions, shall however vest with the National Executive Committee which shall take all the policy decisions in consultation with the Advisory Council. • The selection of candidates for contesting any election at any level on behalf of the Party shall be made by the National President in consultation with the National Executive Committee.
Rules of Discipline The following shall constitute acts of indiscipline: To act contrary to the declared policies of the Party; To indulge in open and public criticism of the policies of the Party; To form a group within the Party or to give support to any member with the object to challenge the authority of a constitutionally appointed office bearer of the party; To spread ill feelings among members or to carry out a campaign of vilification; To obstruct the working of the Party in any way; To misappropriate the funds of the Party; To join a political party or a group or an association not recognized by the Party and whose principles are not approved by the National Executive Committee;
Rules of Discipline To misuse authority vested by virtue of being an office bearer of the Party or to fail to use such authority and thereby bring about a failure of the functioning of a constituent of the Party; To oppose an official candidate set up by the Party in any election; Conviction by a competent court of law in an offence involving moral turpitude in the opinion of the Disciplinary Committee; Furnishing of wrong information in the application form on the basis of which the membership has been granted; and Any other omission/commission prejudicial to the interests of the party
Any member guilty of any act of indiscipline shall be liable to punishment which may include one or more of the following • Expulsion from the Party which may be permanent; • Suspension from the membership of the Party for a specified period; • Removal from office; and • Imposition of disability to hold office which may be for a specified period or permanent.
Any member guilty of any act of indiscipline shall be liable to punishment which may include one or more of the following • There shall be an apex level Disciplinary Committee appointed to enquire into the charges of indiscipline against any member or functionary of the Party. The said Disciplinary Committee shall be appointed by the National President of the Party in consultation with the National Executive Committee. The Disciplinary Committee will follow the rules of the natural justice during the conduct of the enquiries and shall submit its reports and recommendations to the National President who shall take the final decisions in the matters of discipline in consultation with the members of the National Executive Committee. These disciplinary provisions are without prejudice to the other provisions of the preceding clauses pertaining to the removal of the Presidents and other office bearers at various levels of the Party.
Amendment of the Constitution • An amendment of this Constitution can be made by the National Council by a simple majority. However, till the National Council is constituted under the provisions of this Constitution, the amendments, if any required, shall be made by the National Executive Committee by a simple majority • This Constitution has been drafted by Sandeep Dubey, Advocate ,Er Chandrakant Tyagi and unanimously adopted by the office bearers of the Party constituting the National Executive Committee in its meeting held on……………..
