Funding Requirements • Per Title III, section 3114: for a fiscal year, eligible LEAs must have a plan in accordance with Title III section 3116 to receive Title III Funding (LEP & Immigrant) • LEAs shall describe programs and activities proposed to be developed, implemented and administered under the subgrant • Plan shall describe how the LEA will use subgrant funds to meet all annual measurable objectives

  4. 2013–14 Sub-grantee Awards 2013–14 Title III, Part A per pupil amounts: Limited English Proficient (LEP): $93.32 Immigrant: $93.32 LEP & Immigrant funding Notification was posted on RFA pages in October. LEA were notified through list serve. Spending authority as of July 1, 2013 4 4

End of Year Expenditure Reports (1) End of year expenditure reports collected via CARS Winter Release (2011-12 27 months Obligation): Due January 15 through February 28, 2014 Late submission: Contact Patty Stevens at pstevens@cde.ca.gov immediately Obligations: Liquidated no later than 90 days after the funding period (September 30) ends 12 12

  13. End of Year Expenditure Reports (2) • An LEA should only report for the year(s) in which it was funded directly or lead a consortium. • This report must reflect the total or year to date obligations, not just those made since the previous reporting period.

Immigrant Student DefinitionElementary and Secondary Education Act (ESEA), sections 3301(1) and (6) • Age three through 21 • Were not born in any state or commonwealth • Each of the 50 states • The District of Columbia • The Commonwealth of Puerto Rico (this means you cannot report students from Puerto Rico as immigrant) • Have not been attending one or more schools in any one or more states for more than three full (cumulative) academic years 16

  18. 2013–14 LEP Program Private School Participation • LEAs must assess students to identify annually • Private School determines the exit (reclassification) criteria • Funding based on number of identified students served the previous school year • LEA may not impose their own requirements on private schools

  19. 2013–14 LEP Program Private School Participation • The LEA must provide meaningful consultation • A Memorandum Of Understanding (MOU) should be developed before the beginning of the school year • Products or services are identified on the MOU • Never forward funds

In December 2013, the final CA ELD Standards Implementation Plan was presented to Governor Brown and the California State Legislature.
