MAKE UP OF ELECTORAL COLLEGE • CONSIST OF POPULARLY ELECTED REPRESENTATIVES (ELECTORS) • NUMBER OF ELECTORS IS EQUAL TO THE TOTAL NUMBER OF PERSON IN THE CONGRESS • EACH STATE APPOINTS IN SUCH MANNER AS THE LEGISLATURE THEREOF MAY DIRECT, A NUMBER OF ELECTORS, EQUAL TO THE WHOLE NUMBER OF SENATOR AND REPRESENTATIVE TO WHICH THE STATE MAY BE ENTITLED IN CONGRESS • NO SENATOR/REPRESENTATIVE OR PERSON HOLDING OFFICE OF TRUST OR PROFIT UNDER U.S. SHALL BE APPOINTED AS AN ELECTOR.
UNDERLINING ASSUMPTION OF ELECTORAL SYSTEM • EACH STATE WOULD EMPLOY THE DISTRICT SYSTEM OF ALLOCATING ELECTORS • EACH PRESIDENTIAL ELECTOR WOULD EXERCISE INDEPENDENT JUDGMENT WHEN VOTING • CANIDATES WOULD NOT PAIR TOGETHER ON THE SAME TICKET WITH ASSUMED PLACEMENT TOWARD EACH OFFICE OF PRESIDENT & VICE PRESIDENT • THE SYSTEM AS DESIGNED RARELY PRODUCE A WINNER, THUS SENDING THE ELECTION TO CONGRESS
PROS & CONS OF THE SYSTEM • CRITICS ARGUE THAT IT IS INHERENTLY UNDEMOCRATIC AND GIVES SWING STATES DISPROPORTIONATE INFULENCE IN SELECTING THE PRESIDENT & VICE PRESIDENT • PROPONENT ARGUE THAT THE ELECTROL COLLEGE IS AN IMPORTANT AND DISTINGUISHING FEATURE OF FEDERALISM IN U.S. AND PROTECTS THE RIGHTS OF SMALLER STATES.
CONSTITUTIONAL THEORY BEHIND THE SYSTEM • THE INDIRECT ELECTION OF THE PRESIDENT & VICE PRESIDENT IS THAT WHILE THE CONGRESS IS POPULARLY ELECTED BY THE PEOPLE. THE PRESIDENT & VICE ARE ELECTED TO BE EXECUTIVES OF A FEDERATION OF INDEPENDENT STATES.
