Omnibus Recreational Accountability Amendment National Standard 1 Guidelines AMs for when the ACL is exceeded. On an annual basis, the Council must determine as soon as possible after the fishing year if an ACL was exceeded. If an ACL was exceeded, AMs must be triggered and implemented as soon as possible to correct the operational issue that caused the ACL overage, as well as any biological consequences to the stock or stock complex resulting from the overage when it is known.

Omnibus Recreational Accountability Amendment National Standard 1 Guidelines These AMs could include, among other things, modifications of inseason AMs or overage adjustments. For stocks and stock complexes in rebuilding plans, the AMs should include overage adjustmentsthat reduce the ACLs in the next fishing year by the full amount of the overages, unless the best scientific information available shows that a reduced overage adjustment, or no adjustment, is neededto mitigate the effects of the overages.

Omnibus Recreational Accountability Amendment Recommendations Confirm that National Standard 1 Guidelines provide for enough discretion in the application of AMs so that the condition of a fish stock based on best scientific information can form the basis for the nature and magnitude of an AM response. Uncertain nature of recreational fisheries (catch estimates, management controls) necessitates different management approach/response than for commercial fisheries. Continual adjustment of annual management measures may not be necessary when annual variability in catches is below the level of biological significance.
Omnibus Recreational Accountability Amendment Recommendations When best scientific information on stock condition indicates no mitigation [payback] is needed (e.g., when B/Bmsy >1, F/Fmsy <1) that overage paybacks need not be invoked. Decide ahead of time whether prevention of overage in-season is better for a fishery than [potentially drastic] reductions in future fishing opportunity.
