DWP Health Priorities #1 – Acute Human Health Risks • Waterborne disease outbreak • E. coli or fecal coliform present in water sample • Other pathogenic organisms present at levels that introduce a significant risk of waterborne disease • Nitrate or Nitrite contamination above MCL • Inadequate surface water treatment

  2. #2 – Chronic Human Health Risks • Lead contamination above action level • Inorganic chemicals, synthetic or volatile organic chemicals, combined Radium 226/228 and/or gross alpha contamination above the MCL • Failure to install corrosion control when required

  3. #3 - Moderate Human Health Risks • Total coliform bacteria above MCL • Failure to conduct routine monitoring • Copper contamination above 50% of MCL • Chemical/radionuclide contamination above 50% of MCL • Failure to submit plans, or receive approval, for a new water source before adding that source to an existing system

  4. Enforcement Process System becomes a SNC, violations occur or a deficiency is identified. Regulating agency, DWP and water system discuss options for achieving compliance. If the system is not a SNC, the regulating agency coordinates compliance efforts. Is the water system cooperative in efforts to correct deficiency?

  5. If the system takes action to correct the deficiency, no further action is necessary. If the system is not cooperative in correcting the deficiency, the regulating agency issues an informal enforcement letter. If the system is still uncooperative in correcting the deficiency, the regulating agency may continue informal enforcement letter, or proceed to formal enforcement.

  6. Can the system’s SNC status can be resolved before system becomes an exception? Yes No Regulating agency coordinates with system to correct the deficiency before the system becomes a SNC exception. DWP issues Administrative Order to require system compliance. Does the system take appropriate action to correct the deficiency and return to compliance?
