Procurement as a driver for CSR • EC Communication on CSR (2002): “making access to […] public procurement conditional to adherence to and compliance with the OECD Guidelines […] could be considered.” • In the EC Communication on CSR (2006), mention of public procurement as a tool to promote CSR is entirely absent. • National and local governments take the lead: in the Netherlands, all tenders will include social and environmental criteria by 2010.
Can CSR standards be used? • The EU rules are paralleled by the WTO’s Government Procurement Agreement (GPA). • Technical specifications laying down the processes and methods for the production of products, including social and environmental processes, fall within the scope of the GPA. • Technical specifications should be based on international standards, where appropriate, including international social and environmental standards.
What sort of criteria may be included? • ILO core conventions • Minimum wage • Right to safe and sound working conditions • Maximum of working hours • Adherence to the Basel Ban • Adherence to the Rio principles of preventive actions, precaution and the polluter pays • Extended producer responsibility (EPR) Throughout the supply chain
Challenges • Social criteria are difficult to monitor • Materiality and proportionality: problems occur in global supply chains • Boundaries of supply chain responsibility: what is the sphere of influence of companies that supply to EU governments • The role of governments in monitoring and verifying compliance
