  3. Christ Elevated Matrimony • Canon 1055 • Marriage is a covenant • Christ elevated the covenant to a Sacrament Marriage is a covenant, similar to the idea underlying God’s relationship with the Hebrews

  4. Essential Elements • Canon 1057 • Unity • Indissolubility • Consummation • Intention of Procreation

  5. Promise of Marriage • Engagement does not bind people • In some historical-cultural contexts, engagement was binding • However, it may be permissible to seek repairs or compensation if engagement broken off.

  9. Divorce • Exists under Canadian law, but theologically problematic • If divorce is possible, than marriage (as a sacrament) is impossible • Different legal implications between separation and divorce

Annulment • If essential elements were missing, marriage never valid • If one or more party did not truly consent • If one or more party could not truly consent • Role of Marriage Tribunal to determine when marriage should be declared annulled Family and friends often have a good sense whether a marriage was formed on solid grounds.
