Genesis of Proposed Agreement • July 24, 2013 Board of Public Works (BPW) Meeting • KHov request on BPW agenda for Wetlands Permit to: • Install 179 feet of 14” sewer force main beneath Cox Creek via horizontally directionally drilling • Construct 10-slip community pier on Chester River • Total Wetland Impacts: • Zero permanent impacts • 822sf temporary impacts

Genesis of Proposed Agreement • BPW Postponed Vote on Wetlands Permit Pending KHov and the County enter into an agreement to address the following 3 items: 1) Permanent Easement on 131 acre Ecological Park (Tanner Property) 2) Environmental Site Design (ESD) for project stormwater management 3) Proposed reduced project density of 1079 units is contractually met

  4. Status of Proposed Agreement • The agreement received by the County from KHov has been posted on the County Web page for public review. • Commissioners are looking for public input prior to responding/negotiating the proposed agreement

Key Aspects of Proposed Agreement • BPW’s Issue 1 – Eco-Park on Tanner Property • Proposed Agreement provides for the 131 acre property to be deeded to the County • Proposed Eco-Park plan calls for +/- 30 acres for active recreation (multi-purpose ball fields), +/- 100 acres for conservation • County working with State to determine easement structure to ensure land stays in conservation. • Governor’s Office is supportive of proposed plan including active recreation component.

Key Aspects of Proposed Agreement • BPW’s Issue I – Eco-Park on Tanner Property • Per the proposed agreement the property dedication would: • Fulfill the DRRA off-site park dedication (27 acres) • Preclude the DRRA requirement to purchase sewer allocation of 271 units eliminated from Tanner • Fulfill the DRRA infrastructure requirements of: • 1500gpm water well* • Upgrade of CBBP water treatment plant* • Installation of 11,068 lf of 12” water main* *Previously completed with County funds

Key Aspects of Proposed Agreement • BPW’s Issue 2 – Environmental Site Design (ESD) for Project Stormwater Management • Per the DRRA, the Project has an administrative waiver from the current Stormwater Management Regulation • Proposed Agreement, KHov would use “its best efforts to implement ESD practices”

  8. Key Aspects of Proposed Agreement • BPW’s Issue 3 – Reduced Project Density to 1079 • Proposed agreement contractually obligates KHov on limiting density to 1079

Financial Impacts of Agreement • INCURRED CAPITAL COSTS: • County DRRA Infrastructure Costs Incurred to be Waived per Proposed Agreement: • 1,500gpm water well $407,863 • Upgrade of CBBP Water Treatment Plant $200,000 • Installation of 11,068lf 12” Water Main $398,461 • Cloverfields Stormwater Improvements $5,000 • TOTAL COSTS INCURRED BY COUNTY: $1,011,324 • State DRRA Infrastructure Costs Incurred to be Waived: • Piney Creek Turn Lane $150,000 • TOTAL COUNTY AND STATE: $1,161,324

Financial Impacts of Agreement • PROJECTED CAPITAL COSTS: • Development of Eco-Park $300,000* • 4 Multi-purpose fields, trails, plantings, etc. • TOTAL CAPITAL COSTS PROJECTED AND INCURRED: $1,461,324 • YEARLY OPERATING COSTS: • Cost to Maintain Eco-Park per Year $61,244 • Loss of Tanner Property Tax $6,493 • TOTAL YEARLY OPERATING COSTS: $67,737 *Costs include local and state funds

Financial Impacts of Agreement • Benefits • Increased Off-Site Park Dedication: 131 Acres vs. 27 Acres • Environmental Benefits to Cox Creek through preservation practices on Eco-Park – possible Watershed Implementation Plan (WIP) credits • Recaptured 75.2 acres of Critical Area Growth Allocation • Proposed ESD on Development • Reduction in Road and Bridge maintenance through elimination of Bridge to Tanner Property • Yearly Road Maintenance* $14,346 • Yearly Bridge Maintenance* $46,000 • TOTAL YEARLY MAINTENANCE SAVINGS: $60,346 • Yearly Ball Field Tournament Revenue $14,000 • TOTAL PROJECTED YEARLY BENEFIT $74,346 *Includes future replacement annual set asides
