  2. INSURANCE CHANGES • Previously, we shared that we had to make $3 million dollars in insurance changes. • Based on the input from our membership, and in consultation with GESPA, here is what the team feels needs to occur:

  3. INSURANCE • Changes in prescription co-pays: • This year ……………$10-$30-$60 • New, beginning January 2012 • $20 for generic • $40 for formulary (preferred list) • $70 for non-formulary • This change would save us $1,276,800

INSURANCE – Office Visit Co-pays • This year: • HMOs • $20 for general practitioner • $30 for specialist and Urgent Care • PPOs • $25 for general practitioner • $35 for specialist and Urgent Care • New , beginning January 2012: • HMOs (Select Med. and Health Wise) • $25 for general practitioner • $35 for specialist and Urgent Care • PPOs (Med. Plus and Blue Choice’s Health Wise) • $30 for general practitioner • $40 for specialist and Urgent Care • This change would save $336,200

  5. INSURANCE • Contribution Rate Changes • This year’s contribution rate is five (5) percent for employee and 20 percent for spouse. • Beginning January 2012 the contribution rate would change to seven (7) percent for employee and 22 percent for spouse. • This change would generate $1,311,809!

INSURANCE NOTES… • One way to avoid insurance increases, or minimize insurance changes to the benefit plans, is to reduce costs by being a wise a consumer of services. • BE A WISE CONSUMER (e.g. use generics whenever possible; ER is for emergencies, not something that can wait until morning). • Insurance is a bottomless black hole of employee money. It is money that would go to your paycheck if we didn’t have to continue to fund high insurance increases.

  13. What We Got and What We Stopped! • We protected teacher jobs! (But we do have new RIF language in the contract due to the Legislature going after seniority). Details follow…

  14. New RIF Language • The change was dictated by law. • Senator Howard Stephenson went after your seniority, and got his bill passed by the Legislature. • No longer can seniority be used to determine who is terminated in the event of a Reduction In Force (lay-offs versus surplussing).

  15. RIF = Reduction In Force • 19.9.1 The reduction in force process will not apply and need not be followed unless there is a district-wide reduction in force. A district wide reduction in force occurs when the dis­trict is unable to place teachers at the end of the surplus process, prior to the beginning of a new contract year. After the surplus process is complete, the superintendent may release as many teachers as necessary. • 19.9.2 A meeting between the superintendent or designee and a representative of the Associa­tion will be set at least 10 days prior to any final action by the District to reduce teachers as the result of a district-wide reduction in force. • 19.9.3All unplaced teachers will be reviewed by the number of their respective endorsements and certifications, according to the staffing needs of the District. Staffing needs may include but are not limited to the following: endorsements, certifications, pattern of declining enrollments in subject area, endorsements in core academic areas, ESL and gifted endorsements, extracurricular coaching endorsements and certifications, eMINTS certifications, and those who are fluent in a language needed within a school site. Any teacher who has received a current (within the existing school year) written notice of suspension will not be eligible to displace another teacher. • 19.9.4 If a choice must be made between two or more teachers determined by the district to be equally well qualified for the position, the teacher with the most advanced degree and lane placement according to the teacher salary schedule will be retained. • 19.9.5 Teachers released through this process, who are not on active corrective discipline as found within their district personnel file, shall be given the first right of interview for positions for which they are qualified that become available during the six months following their release. Notification of the available position shall be made by a certified letter to the last known address of the former employee. The offer of interview shall advise the person that he or she has seven days after the post­marked date of the letter to accept or reject the offer of interview. If rehired under this section, teachers will be placed on the step they would have received if they had not been released. Offers not accepted or responded to by the seventh day are deemed rejected.

  16. Bereavement Days • 18.1.3.6 Up to five days special use of sick leave will be granted by the principal in the event of a deathin the immediate family as defined above. • This is an increase of two days.

  17. Adoption Leave • 18.7 Adoption Leave. Employees who legally adopt a child who has not previously been a member of the immediate household may take up to ten days of accumulated sick leave. The adopted child must be under the age of 18. Any leave to be considered adoption leave must be taken within 30 calendar days of the day on which the child is placed in the home of the adopting parent(s).

  18. We Protected • We protected your URS retirement benefits! • In fact, the rate of URS contribution has gone up close to half a percent. SO, this is the same as an increase in salary, since you are not paying it out of your pocket.

  19. Other Wins… • We protected prep. periods for all secondary teachers! • We negotiated planning time for all elementary teachers! Details follow…

  20. Elementary Planning Time • 10.2 An increase in elementary planning and collaboration time will be added to the one (1) hour and 45 minutes per week currently allotted to teachers. Each teacher will be given an additional 45-minute block of time weekly—two times per month will be dedicated to teacher planning time and two times per month will be for collaboration time. In the event that the 45-minute planning time falls during an assembly, or other scheduled activities, the principal will arrange coverage for the teacher’s students, thus guaranteeing that the teacher will still receive his or her planning time. This will be accomplished without burdening another teacher for supervision.

  22. Other Wins… • We protected your GSD retirement benefits! • GSD recommended changes to the benefits—specifically changes to the life insurance. • WE SAID, “NO!”

  23. Did you know… your early retirement benefit,that GEA negotiated for you (and continues to protect),is worth more money than 30 years of GEA dues? • It is actually five to seven times as much.

  24. Continuing the Wins… • We protected your salary schedule—no loss of days! In fact, we negotiated for you an additional day of pay. • This will be held before school starts… (.5 day for opening faculty meeting) (.5 day for preparation) If the District had its way, this would have been Prof. Dev., not prep. time for teachers. GEA advocated for the much-needed time.

  25. We Protected • We protected your steps and lanes! • This item alone may protect more than $25,000 over the career of a GEA member if he/she retires from Granite.

  26. THE GOOD NEWS • Steps and Lanes fully funded (cost of $1.8 million). • A number of other districts have had steps and lanes frozen for next year. That money is never recovered!

  27. STEPS AND LANES • Question - Why are Steps and Lanes a core value of the NEA/UEA/GEA? • Answer - Because of the lifetime earning implications. If Steps and Lanes were frozen this year…

  28. The Twilight Zone … • We know many educators are topped out on the salary schedule (out there in the TZ). • In bad money years, educators who are topped out receive no increases (Steps). • We have asked our educators at the top to stay with us. They have, and now we pay them back and bring them back out of the TZ.

  29. The Twilight Zone …NOW Pays • We did negotiate for you a percentage bonus utilizing the Federal Jobs money. This percentage bonus,instead of a flat dollar amount, benefits our teachers at the top who have not realized a step increase for two years now. • If the District had its way, teachers would have received a flat amount. Again, GEA advocated for our members.

Bonus Money Guidelines: • The one-time bonus money will be paid to active educators on the June 30, 2011 payroll check. •  Contract educators placed on salary schedule 20 will qualify for the one-time bonus. •  Contract educators hired after January 18, 2011, are ineligible for the one-time bonus. • The one-time bonus amount will be equal to 1.5% of each educator’s base salary.

  34. Article 2 – New Language • 2.3 The Board, the Association, all teachers covered by this Agreement, and all provisions of this Agreement are subject to the laws and constitution of the State of Utah and of the United States, and to the regulations and orders of state and federal governmental agencies. Any provisions of this Agreement found to be in violation of such laws, regulations, and orders shall be null and void, but this section shall not operate to impair any Agreement or contract during the term of the Agreement of contract.

  35. Article 9 – Faculty Meeting • 9.3.1 Faculty meetings shall not exceed more than one per month except when cleared by School Accountability Director and/or in the event of an emergency. • 9.3.2 Faculty meetings are to be used to manage the logistical operations of the school and to enhance communication with the faculty. Faculty meeting is not to be used for professional development.

Article 12 – False Allegations The Board, Administration, and Association believe that educators need to be able to teach without disruptions from disorderly students and are in full support of teachers, principals, and school staff in their duties to operate safe, orderly schools and classrooms under reasonable rules governing school conduct. Appropriate disciplinary measures should be assessed to students when students make false allegations against an employee that has an affect or impact on the teacher’s employment.

  37. Article 23 – New Language • 23.1.3 The District will establish a 403(b) program for the deposit of district sponsored early retirement monies for eligible teachers. • This was GEA’s brain child as an effort to save our members money.

  39. 403(b) – The Upside • No FICA taxes due ever. Example would gain $3,825 in value over five (5) years; • The IRS does not hold your money; • Funds would still be available on September 15, but GEA and GESPA negotiated to have the District make the deposit on September 12. This meets the legal requirement to remain in the 403(b) account for three days before withdrawal; • Not counted as income by Social Security; • Access to the GSD FICA savings could then go to help fund salary and benefits.

  40. 403(b) – The Downside • Cannot access funds from a 403(b) without penalty until age 55; • Early withdrawal penalty is10 percent ; however, if one calculates in the 7.65 percent saved on FICA taxes, the true penalty is 2.35 percent; (Using the current example, the penalty would be $235); • All employees will be subject to this process.

  41. Year-Round Issues • Commitment from GSD that all services available to traditional schools will be up and running when year-round schools begin.

  42. Fee Waiver Reimbursement • This is a secondary issue. • Principals will be reminded that programs generating fee waiver money will be the programs that receive the reimbursement. • Fee waiver money is not to be used to balance other budgets.

  43. Disclosure of FTE • GSD will provide GEA the FTE numbers by school. • This is to ensure that FTE is being used appropriately.

Article 28 – New Language • 28.1 The GEA President will be released from teaching duties half-time to perform duties as GEA President.   • 28.2 The district will pay the full salary and fringe benefits of the Association President. The GEA will reimburse the district an amount equal to50% of the president’s salary and benefits, less the 10 days allowed by statute.  • 28.3 The president shall receive normal step advancements on the salary schedule during his/her tenure as president. • 28.4 The teacher returning from tenure as President will be entitled to the position the teacher left, or to a comparable position.

  47. The Contract • If approved and ratified by GEA Members and the Board of Education, you will have a renewed contract until the year 2014.

  48. Next Steps • The GSD Board of Education has approved the tentative agreement. But they have not decided how to pay for it. • School Community Councils and PTA have shared what cuts they would like to see. • GSD has cut 45 million dollars out of their budgets over the past two years. • Only thing left to cut is people and services.
