When a juvenile is suspected of violating a criminal statute, the procedure used in a typical criminal case is very different from that used for adult offenders. Every state has established a special juvenile court system for minors who run afoul of the law. Although some minors are eventually found to be delinquent by these juvenile courts, the various players in a typical juvenile court case, including police officers, prosecutors, and judges, have broad discretion in fashioning alternative outcomes.Although juvenile delinquency procedures vary by state, the following is an outline of a typical juvenile case.

  2. How the Police Handle Juveniles cases? A minor may come into contact with law enforcement due to an alleged violation of a criminal statute in a variety of ways. Police arrest some minors, while we refer others to police by parents or school officials. Whatever method the police use to learn about a potential juvenile court case, a police officer may decide to deal with the juvenile in a variety of ways. Keep the minor until a parent arrives. A police officer may detain a minor, issue a warning, and then release the minor into the care of a parent or guardian.

  3. When Cases Are Referred to Juvenile Court? When a police officer refers a case to juvenile court, a prosecutor or juvenile court case intake officer takes it over (often a probation officer). This individual may decide to dismiss the case, handle it informally, or file formal charges (called "petitioning the case"). What Happens If breaking a restraining order? The victim seeks breaking a restraining order to protect themselves from the aggressor. Depending on the behavior of the aggressor, the terms of a restraining order can be different. They sometimes prevent the aggressor from approaching the victim's home or workplace. It may also bar them from contacting the victim in person or through electronic means. Many aggressors who are the subject of a restraining order will willfully violate the order. The ramifications of doing so can be severe.
