6. What You Tell the Chaplain isCONFIDENTIAL and may be PRIVILEGED “Confidential” is a term of art.
-- Confidentiality stems from a relationship of trust.
-- The hearer is entrusted with information the speaker wants kept secret or private.
-- Confidentiality has ethical, professional, and moral responsibilities associated with it; a matter of maintaining faith and credibility.
7. Privileged Communication “Privileged” is a legal term.
-- Protects certain confidential communications from being disclosed in a legal proceeding.
Clergy-Penitent Privilege:
-- Communications made by a person to a clergyman in the course of confession.
-- Also includes communications made to a clergyman acting in his professional capacity as spiritual adviser with the purpose of dispensing religious counsel, advice, or solace.
8. Privileged and Confidential (Con’t) All privileged communications are confidential, but not all confidential communications are privileged.
SECNAVINST 1730.9:
“The term ‘confidential communications’ includes the legal recognition of the clergy-penitent privilege, all communications between Navy chaplains and those who confide in them as a act of religion, a matter of conscience, or in their role as spiritual advisors.”
Bottom Line: what you tell me is confidential and most likely privileged.
