When any cheque drawn by a person for any legally enforceable debt or other liability is returned by the bank unpaid, an offence under Section 138 of the Negotiable Instruments Act is deemed to have been committed. What conditions are required for filing the case ? A demand notice for the payment of the cheque amount has to be given to the drawer of cheque within thirty days of the receipt of information regarding the dishonour of cheque. If the drawer of such cheque fails to make the payment of the said amount of money to the payee within fifteen days of the receipt of the said notice, a complaint has to be filed in the Court within thirty days.
