Why is the County involved in the project? • To ensure the long-range development of Edwardsville and Georgetown areas compatible with long-range community plans • To create a coordinated community effort that would provide a viable solution for all parties involved.
County’s Historical Involvement • July 2005 – Spoke with Georgetown regarding sewer capacity – told staying with NA 500,000 gallons for comprehensive plan • June 2006- Georgetown proposed annexation of O’Brien site • January 2007 – Town submitted pre-application for zoning change • August 2007 – Town submitted full application for re-zoning
County’s Historical Involvement Continued • November 2007 – County Plan Commission and County Commissioners rejected proposed zoning change • April 2008 – Town filed suit against County regarding ability of municipalities to place plants 10 miles outside boundary • October 2008 – Settlement agreement signed by County Commissioners, Town and County Council
What are the County’s responsibilities in the agreement? • Secure up to $1.4 million in USDA loan for permissible costs associated with loan. Those cost are: • Reversal of directional flow from lift stations • Construction of additional sewage and effluent lines • Engineering and design costs • Site acquisition costs
What are the Town obligations under the contract? • Georgetown shall construct a sewage treatment plant at the Alternative Site at such a location as Georgetown shall select, to be owned and operated by Georgetown and the same shall be compatible with all Floyd County related land use plans, • Option given to County to accept $350,000 or O'Brien property once Rural Development loan has been closed
How can the agreement be terminated? • New Albany fails to amend rate agreement signed by Town and City in 2006 • Floyd County is unable to get Rural Development financing • Georgetown is unable to get required permitting • Georgetown fails to get needed approval through Floyd County Zoning

Loan Application • County and Town are co-applicants due to Town ownership and operation of the plant facility. County will pay for loan. • Application form submitted March 20, 2009
Rural Development Loan • Four Phase process • Site Control Established • Preliminary Engineering Report • Financial Data • Regulatory Signatures • Before closing loan, Bidding will take place and Bid for the work associated with the County’s portion will be awarded. • Upon award, the loan closing will take place
Financing Plan • United State Department of Agriculture (USDA) • Rural Development, Community Facilities Loan • Term – 40 years • Rate – 4.625 (currently) • County to use Riverboat funds as payment
Site Acquisition • County provided Town with 15 sites in May 2008. Town paired sites to 4 sites in October 2008. All sites would be compatible with Floyd County Land Use Planning documents. • Town had identified four sites for appraisal in February 2009. • Process must follow Uniform Relocation Act (URA) to obtain federal loan funds and be eligible for additional grant funds • A land option on the selected property is necessary. • Associated site acquisition are eligible costs for reimbursement through loan
What other actions has the County assisted in this project? • Introduced grant writing/administration agency River Hills to process to expedite potential funding sources • Identification and explored EDA, CFF, and stimulus funding for possible funding • Submission of Congressional Appropriation request for $800,000 • Assisted with collection of income surveys to assist in the CFF process in County areas and Town areas • Estimated County staff has spent 700 work hours on this community project in last 14 months
Environmental Review • Nine federal and state agencies have to respond • Seven agencies have responded – no negative statements • Waiting for DNR –Water comments and SHPO final letter • State Historic Preservation Office has requested an archaeological reconnaissance on the selected site
Financial Review • Financial data has been submitted to Rural Development Office • Remaining assurances and loan paperwork will be processed once preliminary engineering report has been submitted
Preliminary Engineering Report • Town engineer met with USDA representative and County Planner in November 2009 regarding PER and Rural Development requirements
Present status • Rural Development loan application can not move forward until the Town has moved forward on the following: • Site acquisition • Town will need to obtain an option on property • Property will need to go through Floyd County Planning and Zoning • Preliminary Engineering Report • Submitted to Rural Development for review once site has been controlled • Environmental Review • Archaeological Reconnaissance needed once site has been controlled for SHPO response • Financial • Rural Development office will submit needed loan documents once PER and Site Acquisition has been resolved
County will be establishing a link on County website • Link will allow community residents to check in to view status of project • Link is: www.floydcounty.in.gov • Go to County Office icon and select Planner • Icon labeled – Georgetown WWTP project • Status will be updated weekly regarding progress
