Registration of the Learnership Agreements. • Employer, Learner, and Training Provider signs the Learnership Agreement. • Service Provider/Employer upload the LA on the SMS and submit 2 original copies to the seta. • Receive the Learnership Agreement • Register the agreement on the LA Register. • Administrator verify the L Agreement. • Forward to Regional Coordinator for reverification and stamp of approval. • Forward back to administrator for registration on the SMS(touch of a button.

DUTIES…Learner • The Learner must: • Work for the employer as part of the learning process • Be available for and participate in all learning and work experience • Comply with workplace policies. • Complete all assessment tools supplied by the employer to record relevant work place experience. • Attend all study periods and theoretical learning sessions with training provider.
Duties…Employer • The employer must: • Comply with all applicable Labour legislation • Provide learner with appropriate training and facilities in the work environment. • Provide adequate supervision. • Release the learner during normal working hour to attend the theoretical lessons • Pay the learner the agreed learner allowance. • Ensure that on the job assessment is conducted. • Have an employment contract for the duration of the program.
Duties…Training provider • The training provider must: • Provide education and training in terms of the Learnership. • Provider support to the learner as required. • Record, monitor and retain details of training provided, or cause it to be conducted. • Conduct off the job assessment • Provide reports to the employer on learner performance.
Agreement Termination • The Learner agreement terminates: • On the date of termination stipulated in part B of the Agreement.
Termination cont… • On an earlier date if: • The learner successfully completes the learnership. • The learners is fairly dismissed by the employer for a reason related to the learner’s conduct as an employee • The learner and employer agree to terminate. • The SETA approves a written application to terminate the Agreement by the learners or the employer if good cause is indicated
Learnerships Agreements • To be complete and signed by all parties • Initials on each page (all parties) • Company (and Provider) logo(s) in addition to the SETA & DoL logos • Submit two original copies • Parent/Guardian signature for minors (under 21years)
Learnership Agreement • Attachments: • Contract letter of employment for the 18.2 learners • ID Copy • Results/evidence of the placement assessment process • Completed grant claim form • Provider status on Accreditation and Approval of Programmes • Learner information form.
Process for registration of Agreements Employer, Learner and Provider completes Agreement. Employer upload the LA on the SMS and sends 2 (two) copies of LA to W&RSETA The SETA must decide whether or not to register a learnerships agreement within two weeks of receiving the learnership agreement W&RSETA sends one copy of each registered Agreement to Employer. W&RSETA verifies information, records and registers each Agreement (signed and dated)
