ALBANIA EXPERIENCE TO PREVENT ILLEGAL TRADE OF ODS Albania has ratified the Vienna Convention and the Montreal Protocol in October 1999. The National Ozone Projects Implementation Unit has set to Work in the beginning of the year 2003. During the February and March 2006 the Albanian Parliament by specific laws has approved all Amendments of Montreal Protocol as London, Copenhagen, Montreal and Beijing.
Albania’s obligation under the Montreal Protocol and its amendments include: • Phase out the production and consumption of all controlled uses of ODS • The implementation of the import quota system of ODSs, making their reduction until the import of ODS in 2009 to arrive zero as per the Agreement. • The implementation of a licensing system of the activities, which are related to ODS. • The implementation of monitoring system and the report regarding the activities related to ODS.
The approval of the Council of Ministers' Decree Nr 453 date 23.06.2005 on “Taking the measures for the removal of the Ozone Depleting Substances" has fulfilled one of the main obligations of the Albanian Government to introduce the import & export licensing and quota system. This legislation is according to the legislation of the European Countries. The project of the “Monitoring and Auditing is in the process. Two national experts have signed contract with UNIDO and are included in the monitoring process. During the year 2006 there have been two workshops for the implementation of the Council of Ministers' Decree Nr 453 for customs officers and local environmental inspectors in different areas of the country.
The project for training of customs officers has been successfully completed and the certification scheme for customs officers is operational. • ODS identifiers are located in different border points and local environmental inspectors have been trained on how to use them and certified. • There are a lot of custom officers and local environmental inspectors moving out for the reason of the reform.
Introducing harmonized system of tariff codes withASYCUDA custom system allows risk profiling. CFCs are automatically sent to the “red channel”, means that such substances in the tariff codes are treated with the same system as drugs. The system facilitates the monitoring of imports & exports of ODS. The System of Customs is going towards the computerizing of 90 % of all customs information. This make easier to take any information by customs in the center and in the border points. The necessary structures exist in Albania for the monitoring and collection of the information with regard to the import of ODSs and the equipment that use and contain them.
In collaboration with experts from General Customs Authority we are preparing the Manual for Customers to prevent ODS illegal trade. In this Manual will be included the Guide for Customers how to operate on Controlling of ODS import and products and equipments that contains such substances in the border points.
As a normal procedure in the customs border is: 1. In the first step the importer provides all obligatory documents to Customs including: customs declaration, the list of charge, the invoice, the certificate of origin, NIPT , the license etc. In this case the importer it need to has the license with quotas ( as is in our obligation confront M.P.) given by Ministry of Environment, Forestry and Water Management. In this license is include the tariff code of ODS imported too. In case the importer has not the license given by ministry the customer between the legal document make the blocking of the charge. In this document are given the reason of this blocking act. One copy of this document it need to give the imported. In case that in five days the situation was not change or the importer refuse to provide this license the custom authority make sequestration of the goods. In the same time the customs authority take contact with NOPIU

In the second step Customs verifies the paperwork including the customs declaration, value of the charge, the tariff code etc. In case of doubts, the importer will be requested to provide additional documents such as contracts, evidence of payments etc. It is an important paper th certificate of origin. In case that the charge is imported by country as China, India etc customer take more attention during the process of verification. 3. In the third step Customs does physical control .If it is necessary to verify the quantities, to take samples etc. The physical control does not happen every time. Physical control is mandatory process for “red channel” as is for ODS imported. In case that samples are in conformity with documents the physical customer continues the normal procedure.
4. In case of irregularities, the General Customs Authority may decide on different penalties.as are in our legislation. In the same time all expenses that are doing during the physical control there are under the importer. The implementation of this procedure in the customs border give possibility to prevent illegal trade of ODS. The execution of this procedure and the collaboration of the Department of Statistics of the General Directory of Customs with the NOPIU, allows to produce a report in conformity with the guidelines and the recommended annexes by the Ozone Secretariat with regard to ODS. Concerns the ODS import, Albania, in these years, has fulfilled the obligations towards the quotas defined in the Agreement of the Albanian Government with Executive Committee.
For the first time in the country the license for the import ODS with quotas for 2006 was approved by Ministry of Environment, Forestry and Water Management. Only one company has a license to imports ODS in 2006. This makes the monitoring process easier. For the first time in 2004 and 2005, by means of the launched auditing and monitoring projects financed by the MLF through UNIDO, the stock-taking of the activities was made possible that has to do with ODS and their consumption in Albania.
Next steps: Strengthening of ODS monitoring system and the licensing system’s capability. Improvement of the risk profiling to prevent illegal trade of ODS as for example: • to add in Profile Risk the quantity and the tariff code of ODS imported for which year • to fixed not more then 4 border point where is possible to imported ODS etc .
