  3. Special Measures instead of Criminal Prosecutions (pre-indictment)( Section 86) 1. The case in which the punishment not exceeding 5 years imprisonment 2. The injured parties give consent to the rehabilitation plan

  4. Process 1. The Director of the Observation Center proposes the plan to the public prosecutor 2. If the Public Prosecutor agrees with the plan 3. The Director of the Observation Center submit the plan to the Court 4. If the Court approves the plan. The Public Prosecutor issues an non-prosecution order

  5. Post-prosecution Special Measures ( Sect.90 ) 1. Children or Young Persons charged with criminal offense punishable with 20 years imprisonment, even with or without fine. 2. No prior conviction, except : 2.1 Offenses committed through negligence 2.2 Petty offense 3. The Children or Young Person feels remorseful to their actions

  6. 4. With the consent of the Victim 5. The Prosecutor has no objection 6. The circumstance is not extremely harmful to the society 7. The children or Young person can change their behavior 8. The possibilities of the victim to obtain reasonable compensation.

  7. The Process of the arrangement of the Rectification and Rehabilitation plan ( Section 90 ) On the Conference day, the Court will ask the Children or Young Person and provide the chance for the Children or Young Person to express their feelings toward their actions

  8. - The Court makes clear the purpose of the arrangement of rectification and rehabilitation plan to the Children and the parents. The Court has to consider the consent and the cooperation of the Children or Young Persons before it approves to initiate the plan. - If the victim gives consent to the plan, then the Court will order that the plan will be proceeded.

  9. The process after the court’s order of the plan arrangement 1. The court officials, psychiatrist, social worker gather the information and make a file to submit to the court 2. The court appoint an coordinator for the conference 3. The Coordinator arrange an conference with the relevant parties in order to draft the rectification and rehabilitation plan, and submit the plan to the court within 30 days after the appointment.

  10. The content of the Plan consists of 1. The comment and the common opinion of the participants of the conference. 2. Various measures for rectification and rehabilitation 2.1 The rectification and rehabilitation plan must be consistent with the problems of the Child and Young Person offender. 2.2 Factors and environment relating to the Children and young Person

  11. 3. The measure of the rectification and rehabilitation plan must facilitate with the restitution to the victim 4. With the consent of the children, Young Person and the victim. 5. The time frame of the plan must not exceed the time when the Young Person attains the age of 24 Years old.

  12. 6. No restrict to the rights and liberty of the Children or Young Person, except for the true benefit of the Children or Young Persons - After the Court receives the plan from the coordinator, the Court will hold a meeting to consider the plan. - If the Court agrees with the rectification and rehabilitation plan, the Court will dispose the case. - If the court is of opinion that the plan is not legitimate in any matter, the Court will order an amendment. If the amendment is not possible. The court will cancel the plan and bring the case for further trial.

  13. Special measures instead of trial ( Section 132 Paragraph 1) 1. The court is of opinion that the circumstance of the Child and Young Person is not extremely harmful. 2. Applicable when the trial is over. 3. The Court asks the victim for its discretion. 4. No limit to the velocity of the punishment.

  14. 5. The Court prescribes the conditions for the rectification and rehabilitation to the child or Young Person. But if the Court think fit , the Court may appoint a person to be responsible for the rectification and rehabilitation. The regulations which the Court will impose for rectification and rehabilitation to the child or Young Person must be consistent with the regulations prescribed by the Supreme Court, with the following guidelines ;

The Child or Young person reports himself to the probation offer or obtains counseling, or participate in rehabilitating activities. 1.1 Example of rehabilitating activities : - vocational training - religion activities • other alternative activities 1.2Safety measures or probations : - Prohibition of association with bad persons - Prohibition of entering into certain venues - Prohibition of leaving his own dwelling at night - Other conditions

  16. Remark If the Court thinks fit, the Court may order the psychiatrist, social worker to draft the rectification and rehabilitation plan, and propose to the court for consideration.
