New Jersey vs TLO 1985 By Anna Payonk Ashley Gray
Constitutional Issue • Do students in school have the same rights under the 4th Amendment as adults? • Does “probable cause” have to be established for the search of a student in school, or is “reasonable cause” enough?
Litigant 1 • New Jersey
Litigant 2 • Tracy Lois Odem (TLO) 14 year old girl
Background of case • TLO was a 14 year old girl; she was accused of smoking in the girls bathroom of her high school. A principal at the school questioned her and searched her purse, yielding a bag of marijuana and other drug paraphernalia.
Majority opinion • The school was right to search her purse
Other court opinions • 6-3 • 6 for New Jersey • 3 for TLO
Significance • Kids should follow the school rules. The school is allowed to do searches
My response to the case • I think that they do have a right to search. Don’t have anything on you, your not suppose to have
