Report on the Implementation Plan on Management of Trafficking in Persons during the 2010 FIFA World Cup • Identify Trafficking Cases under current Legislation : • Through the 2010 FWC AoJ project the role players in the provinces were encourage to participate in this training. • Training was conducted in eight provinces included training on the various pieces of legislation that could be used in prosecuting perpetrators of human trafficking including • Statutory Offences related to trafficking in persons : • Sexual Offences Amendment Act 32 of 2007; • Children Act, 2005 (Act 38 of 2005); • Films and Publications Act, 1996 (Cat 85 of 1996; • Prevention of Organised Crime Act, 1998 (Act 121 of 1998) etc. • Human tissues Act 65 of 1983 • Corruption Act 94 of 1992 • Infringement of Immigration Act 13 of 1996 • Refugee Act 130 of 1998 • Extradition Act 67 of 1992 3
Report on the Implementation Plan on Management • of Trafficking in Persons during the 2010 FIFA World Cup • Identify Trafficking Cases under current Legislation : • - Common law offence relating to trafficking persons • Kidnapping , • Common Assault , • Extortion , • Slavery , • Attempted Murder and Murder • Trafficking in person for forced and child labour and assault with intension to do grievous bodily harm • The “Human Trafficking: Frontline Officers Frontline Services Guide on Managing Human Trafficking and Related Crimes” was produced and included screening; processes to be followed in managing trafficking cases and victims and referral. • A distribution strategy will be developed and an evaluation will be conducted after the passing of the Trafficking in Persons Bill to determine the need for its amendment or improvement. 4

Refugees Act, 1998: Use of Asylum Law to protect victims of human trafficking • In light of the potential of victims of human trafficking being deported back to their country of origin if found without relevant travelling documents, • the Portfolio Committee requested the Department of Home Affairs to • clarify whether asylum laws could be used to protect the victims pending the prosecution of perpetrators. 5

Shelters for Victims of trafficking and contact details of Safe Houses: Progress • 13 Shelters/Centres were identified for victims of trafficking. One shelter was identified in each province except for in KZN and Western Cape where two shelters/centres were identified and three in Gauteng. • The Shelters personnel received a two day orientation workshop on the implementation of the human trafficking rehabilitation programme in April 2010. • The shelters were provided with a tool kit that includes amongst others: 9 Week Programme • Four Modules on Structured Therapeutic Programmes were delivered to empower victims 6

Shelters for Victims of trafficking and contact details of Safe Houses: Progress (Continued) • The roles and responsibilities of the social service providers were identified as including:- • - Screening and assessing for admission • - Identifying short and long term needs • - Developing individual development plans for each victims • - Preparation of the victim for re-integration into the community and or repatriation. • - Intensive skills development training on the Rehabilitation Programme will be conducted from the 2nd to 6th August 2010 for the 13 identified shelters. 7
4. Services for Victims of trafficking Progress • Repatriation – International Social Services Directorate (ISS) within the DSD is responsible for linking victims of human trafficking and works with NGOs within the various countries/provinces of origin. • - The NGOs are trained to conduct an assessment of the families of victims of human trafficking to enable them to conduct a situation analysis of the condition that the victims will be re-integrated into. • - The aim of the training is to ensure sensitive repatriation or relocation of the victim back in her family and community • The DSD developed as part of its FIFA World Cup Strategy the Standard Operating Procedures for victim which have been developed and have been distributed to the VEP Coordinators and Shelter Managers. Services for Victims of trafficking Progress (Continued) • A Pilot programme on the implementation of the Rehabilitation Programme is being conducted in the shelters from May to December 2010. There will be continuous support and guidance provided to the shelters. • The NPA through the court preparation and DOJ&CD through intermediary services planned to provide services to victims of human trafficking. As there were no cases which went through the FIFA World Cup Dedicated Courts these services were not utilised in relation to the event. 9
Report on the Implementation Plan on Management of • Trafficking in Persons during the 2010 FIFA World Cup • Information Management • The 2010 FWC AoJ developed a special process for identification of 2010 FWC related cases which was adopted by The NATJOC • The DSD developed an Information Management Tool to provide information on the victims of human trafficking in shelters to determine the trends and the nature of the phenomenon. A report will be made available in August 2010. • No human trafficking cases were reported through the FIFA World Cup Dedicated Courts. • The report of the Department of Home Affairs is still outstanding. 10

Communication and Public Awareness • The FWC AoJ communicated the importance of identification of possible Human trafficking cases to all the Regions. • The Minister of Justice and Constitutional Development launched the “Red Card Campaign” on Human Trafficking. This was an indication of the political will to deal with Human Trafficking effectively by the Department. • The Red Card Public Awareness Campaign led by the Inter-Departmental Management Team was implemented in conjunction with the CGE, FIFA, UNICEF and Community Based Organisations. The campaign included the “knock and drop” of publicity materials in homes and was mainly implemented through volunteers in Nelspruit during the media launch. • A circular was published on the contents of Children’s Act 38 of 2005 on protecting children from human trafficking. 11

Communication and Public Awareness (Continued) • Departments provided Standard Operation Procedures including procedures of human trafficking to the NATJOC and PROVJOCs. • The “Human Trafficking: Frontline Service Guide in Managing Human Trafficking and Related Crimes” was developed from the Standard Operating Procedures for use by Frontline Officers. • Department of Women, Children and People with Disabilities conducted a workshop on human trafficking with stakeholders from both government and non-governmental organisations. 12

Training • The Department of Justice and Constitutional Development together with SAPS and NPA facilitators conducted 8 provincial blitz training on the Trafficking in Persons in all the 8 Provinces. In most of the provinces the Department of Social Development had already conducted training. • The Department of Social Development conducted training on different methods of Counselling i.e. Trauma Counselling; Referrals and Coaching for the JCPS Cluster Departments’ National Office officials. The second training will be conducted during August 2010 to ensure that all officials have skills to manage traumatised victims who they may come into contact with. 13

Training (Continued ) • Department of Labour trained Inspector to ensure compliance with employment legislation through conducting workplace inspections as part routine inspections. 100 officials were trained through the Tsireledzani Programme to ensure appropriate referrals. No report was received in respect of Trafficking in children for labour purposes. • 9. Budgets • Departments utilised their existing budgets to fund their activities. • The Department of Justice funded the “Human Trafficking: Front Line Service Guide on Managing Human Trafficking and Related Crimes”.100000 copies to be printed and distributed to the various department. 14

Background The 2010 FIFA World Cup Administration of Justice Project was initiated to determine the roles of the various IJS stakeholders; in particular the Department of Justice and Constitutional Development (DoJ&CD), the National Prosecuting Authority (NPA), Legal Aid South Africa (LASA) and the Judiciary, in ensuring the effective Administration of Justice during the 2010 FIFA World Cup and to integrate with other stakeholders/ stakeholder plans. 2. Project Objective To deal with all criminal matters, emanating from the 2010 FWC event, in a fast and efficient way, especially where foreigners are involved (either as a complainant/witness or accused). 1 3

Legacy Aspects Infrastructure • Facility and Security upgrades • Installation of generators at the dedicated Volunteer Program • 293 Unemployed Youth were trained in an accredited Customer Service Management course. • Training funded by the SASSETA • During the 2010 FWC a number of these Volunteers were deployed at the dedicated courts • Beyond the 2010 FWC the DoJ&CD will look for opportunities to utilise the volunteers within the department e.g. internships Court Operational Centre (COC) • This structure was developed to monitor and manage all 2010 related aspects in the dedicated courts, at court operational level. 1 15
