Which Discipline Data Should be Reported to CALPADS? • LEAs must report ALL INCIDENTS for students that are a result of offenses outlined in Education Code 48900 and 48915. • An incident is: • One or more students • Committing one or more Education Code 48900 or 48915 offenses • On the same date

Which Discipline Data Should be Reported to CALPADS? • LEAs must also report the associated outcomes (disciplinary actions) associated with each student for a particular incident • Disciplinary actions (including “other means of correction” or no action) of ANY duration should be reported (including ZERO)

15. Issues with Current Discipline Collection • Trends in the data reported to CALPADS show the rates of suspension and expulsion dropping annually, however those incidents resulting in “No Suspension or Expulsion” are also decreasing • Recent site reviews have revealed in some instances that LEAs are not reporting all incidents and associated disciplinary actions • There is ambiguity around what constitutes a “suspension”, and “in-school suspension”, and “other means of correction” or “no action”

16. Issues with Current Discipline Collection • CALPADS currently only collects the final disposition of an incident for a student • Does not allow LEAs to report ALL disciplinary actions for an incident for one student (e.g. one student receives two days in-school suspension and five days out-of-school suspension for the same incident) • Causes discrepancies between the SDIS and Student Absence Summary (STAS) Files • Duration Days only represent the duration of the final disposition and not cumulative duration for all removals for the student within an incident

18. Proposed Changes to Discipline for 2018-2019 • CDE will be clarifying the following Disciplinary Action Codes • 100 - Out-of-School Suspension Education Code Section 48925(d) removal of a pupil from ongoing instruction for adjustment purposes, including out-of-school teacher suspensions as defined in Education Code Section 48910.However, suspension does not mean any of the following: (1) Reassignment to another education program or class at the same school where the pupil will receive continuing instruction for the length of day prescribed by the governing board for pupils of the same grade level. (2) Referral to a certificated employee designated by the principal to advise pupils. (3) Removal from the class, but without reassignment to another class or program, for the remainder of the class period without sending the pupil to the principal or the principal's designee as provided in Section 48910. Removal from a particular class shall not occur more than once every five schooldays.

19. Proposed Changes to Discipline for 2018-2019 • 110 - In-School Suspension Determined and established by local districts as a supervised in-school suspension classroom for students who are suspended and do not pose an imminent danger or threat or have not been recommended for expulsion as provided in Education Code Section 48911.1. In-school suspensions also include in-school teacher suspensions as defined in Education Code Section 48910.

20. Proposed Changes to Discipline for 2018-2019 • 300 - Other Means of Correction or No Action (Formerly No Suspension or Expulsion) An individual committed an offense as defined in Education Code 48900 or 48915, was not suspended or expelled, but the matter was addressed with either no disciplinary action at all or other means of correction. Other means of correction includes but is not limited to: • A conference between school personnel, the pupil’s parent or guardian, and the pupil. • Referrals to the school counselor, psychologist, social worker, child welfare attendance personnel, or other school support service personnel for case management and counseling. • Study teams, guidance teams, resource panel teams, or other intervention-related teams that assess the behavior, and develop and implement individualized plans to address the behavior in partnership with the pupil and his or her parents. • Referral for a comprehensive psychosocial or psychoeducational assessment, including for purposes of creating an individualized education program, or a [Section 504] plan . . . • Enrollment in a program for teaching prosocial behavior or anger management • Participation in a restorative justice program. • A positive behavior support approach with tiered interventions that occur during the school day on campus. • After-school programs that address specific behavioral issues or expose pupils to positive activities and behaviors, including, but not limited to, those operated in collaboration with local parent and community groups. • Any of the alternatives described in Section 48900.6 [relating to “community service”].

21. Proposed Changes to Discipline for 2018-2019 • Duration Days definition is being amended and should represent ALL days a student was removed from instruction due to disciplinary actions related to an incident. • Example: Student is involved in a fight on 9/2/2018. The student receives in-school suspension for two days, then ultimately receives an out-of-school suspension for five days. • Disciplinary Action reported to CALPADS – 100 - Out-of-school suspension • Incident Date: 9/2/2018 • Duration Days – 7 • Suspension and Expulsion Duration Days of ANY increment should be reported for ALL students - not only students with disabilities

22. Proposed Changes to Discipline for 2018-2019 • SDIS file will be required for ALL Nonpublic Nonsectarian Certified Schools • Currently these schools are permitted but not required to submit the SDIS file

Additional Data Collection for 2019-20 for ALL students • AB 2657 - Restraint and Seclusion • Incidents resulting in any of the following actions: • Physical restraint • Mechanical restraint • Seclusion • Will likely be collected in the Student Discipline file • Uses same definitions as the Office of Civil Rights Data Collection • Must be collected for Nonpublic Nonsectarian Certified (NPS) schools
