Present Tendency in Industry • engineering of chemical factories for global application (package unit strategy) • global trade of products (one product line) makes more profit • safety is enhanced by using one system (Zone classification) and one installation, maintenance, repair code
Question: Is free trade of 94/9 products in a global scale possible? • WTO rules require the stepwise abolishment of TBT • one option: bilateral MRAs for Standards/Certification Bodies • bilateral MRA strategy needs too much administrative resources • more efficient: a global certification scheme matching the ATEX requirements with a multilateral approach
IECEx Certification Scheme key elements • IEC/TC31 standards (IEC 60079-0 foll.) as scope • Accreditation procedures in accordance with ILAC requirements plus specific Ex Technical Guidance Documents • List of recognized technical experts with Ex test experience, one of this group must be member of the audit team (‘peer assessment’) • IECEx Certificate of Conformity:A. Product AssessmentB. Production audit with an Ex expert in the audit team
Is IECEx a 100% match of the 94/9-requirements? Standards • In the near future electrical apparatus are 100% IEC by Parallel Voting Procedure CLC/IEC • Additional marking required by 94/9 is addressed in the Foreword CLC to cover Annex II and X • Cross reference lists are available - just to be maintained after new standard edition, to be published on the ATEX-Homepage • To keep control and compliance of IEC documents with ESHRs: CLC/TC31 stops technical work and sends European experts to IEC/TC31/SCs/MTs
Is IECEx a 100% match of the 94/9-requirements? Accreditation • Accreditation: to use ISO/IEC 17025 is a missing requirement in EU • Annex XI seems not to be ‘State of the Art’ • IECEx and its assessment rules are perfectly in line with ILAC (see cooperation and joint assessments) • Accreditation in accordance with international rules should be preferred compared with a “Notification”
Is IECEx a 100% match of the 94/9-requirements? Certificate • the -declaration is not giving evidence of the expiration of the QA Notification users often complain • IECEx Certificate of Conformity will provide a link to the QA-Notification/QAR • My conclusion: • IECEx requires more than 94/9, it is a 100% match
How to proceed? • Standing Committee forms a WG IECEx/EU to evaluate IECEx Rules in order to get an overview about potential non-conformances with 94/9 in detail Target 06/2003 • non-conformances to be presented in IECEx WG 1 - 06/OCT/2003 in Budapest, revision proposals to be created • Revision of the rules presented on ExMC meeting 08/OCT/2003 • New Version IECEx02 March 2004
How to proceed? • WG IECEx/EU creates an multilateral agreement draft between IECEx and EU- only 100% IEC Standard application (NBs still can apply other documents or own test requirements)- only those IECEx-CBs are recognized in EU which are located in a country having signed a reziproke agreement with IECEx
