  3. NPAMission Guided by the Constitution, we in the National Prosecuting Authority ensure justice for the victims of crime by prosecuting without fear, favour or prejudice, and by working with our partners and the public to solve and prevent crime.

Special initiatives to support victims of crime • The creation of the Sexual Offences and Child Abuse Unit (SOCA); • Specialised Commercial Crime Unit (SCCU); • Community Courts; • Restorative Justice processes; • Victim Offender Mediation; • Community outreaches by prosecutors. • The creation of Court Preparation Officers posts(139 posts created – 68 appointed); • The creation of additional Prosecutors posts (163 in 2006 and 284 in 2007)

SOCA activities • The establishment of sexual offences courts – 61 in total • Creation of Thuthuzela care centres (TCC) – 10 established and managed, whilst deliberations are presently underway for additional TCC’s to be established.   • Victim support services including victim assistant officers   • Public Awareness Campaigns in all provinces (totals are all inclusive)   • Adopt a school project for prosecutors • Speak-out campaign, 356 478 learners in 450 schools  • Adult workshops, 5163 attendees • Participated to increase the number of diverted child offenders. • Structured establishment for effective and efficient maintenance management in the provinces (70 juniors and 10 senior maintenance prosecutors)

SOCA activities • Sexual offences bulletins, 7 in total (dealing with the latest developments in law regarding sexual offences, recently the scope was extended to include domestic violence, maintenance and young offender management).    • Based on a cabinet mandate the Unit is leading an inter departmental management team (IDMT) in the development of a National Anti-Rape strategy focussing on prevention, reaction and support. • Case management project for sexual offences administered by appointed case managers • Development of an Integrated Domestic Violence Training Manual, first of its kind. The manual formed the basis of prosecutorial training for various delegates as from May 2005 until present.    • Project Ndabezitha (for Traditional Leaders), to ensure cooperation and coordination in combating the spread of domestic violence in rural and urban areas.

SOCA activities • Inputs to law reform (Sexual Offences Bill, Child Justice Bill, Films and Publication Act, discussion document on Stalking, Interim Legislation on Human Trafficking) • Sexual Harassment policy developed, approved and implemented fro the NPA. • Multidisciplinary skills development (2677 delegates in total), in the following fields of expertise: advanced skills on prosecuting the child sex offender, diversion training, integrated domestic violence training, maintenance, child pornography, multi-disciplinary training on sexual offences prosecutions and investigations. • National and Provincial oversight committees in dealing with gender based violence matters on a national and provincial strategic level. • Baselines developed by the Task Team for domestic violence, maintenance, child justice and sexual offences. • Specialist prosecutors prosecuting sexual offences cases in dedicated courts.

THUTHUZELA CARE CENTRES Objectives • Reduce secondary victimization • Reduce cycle time to finalisation • Improve conviction rate Essential Requirements • Location – secondary or tertiary health centre • Transportation - provided by SAPS • SAPS – specialised officers on site to take statements • Health care services – specialised in collection of forensic evidence and clinical care • Site Coordinator – to coordinate services • Social Services/NGO’s for counselling • Victim Assistance Officers – to assist the victim through the criminal justice system • Cases to a Sexual Offences Court • Case Manager – tracking the case

SEXUAL OFFENCES COURTS • Objectives of Sexual Offences Courts • Reduction of secondary victimisation • Reduction of the turn-around time for finalisation of cases • Improve the conviction rate • Increase the reporting rate Essential Requirements • Prosecutors • Victim assistant services • Judge / magistrate • Specialised Courts (structure and equipment) • Intermediaries • Support services • Legal Aid • Local Project Oversight Committee (LPOC)

SCCU • This Unit consists of specialist prosecutors and investigators tasked with the investigation and prosecution of complex commercial crime cases; • They work in collaboration with victims of commercial crime, the SA Police Service and other stake holders to successfully prosecute offenders; • A Client Charter has been created and published.

  12. Justice successes and opportunities Dedicated courts are reaping results: e.g. Special Commercial Crime, Sexual Offences Special units making impact: E.g. SIU, AFU, DSO Opportunity to do CJS-wide, integrated planning, execution, monitor and review Accelerate sustainable, proactive approach to dealing with CJS challenges, constraints, maximize successes, opportunities Contribute to regional and African continent learning, skills development, joint planning, collaboration, etc. Maximize economies of effort, scope and cost Facilities at a Sexual Offences Court in Kimberley. Dedicated courts are customised around the needs of customers and justice delivery, and are reaping results. These courts have a transcription machine, one-way window for identification of witnesses, TV for screening evidence, and a Closed Circuit Television System

Ensuring service delivery • Strategic initiative projects: Governance – The NPA will work towards consistently delivering value to its stakeholders within the framework of the Constitution, applicable laws and generally recognised governance principles, by: • Establishing a Governance Centre to develop governance capabilities and ensure good governance • Establishing a national programme management office for the NPA, to manage and govern projects • Launching and implementing the NPA Strategy 2020, effective monitor and review of execution, impact A sign-off ceremony to celebrate the NPA’s launch of its strategic initiative projects, kicking off in 2006/07. Some 23 project scopes of work were signed off, as well as the NPA’s Strategy 2020. These projects deal with key strategic priority to ensure justice service delivery, efficiency, effectiveness, sustainability and a proactive approach.
