Title III Legal References • The Superfund Amendment and Reauthorization Act (SARA) was signed into law by President Reagan in 1986 as a revision to federal legislation dealing with hazardous substances and toxic wastes. SARA Title III, known as the Emergency Planning and Community Right to Know Act (EPCRA), required the development of a State Emergency Response Commission (SERC) as well as Local Emergency Planning Committees (LEPCs) to manage hazardous materials preparedness at the State and county level. • In addition to State and local planning requirements, EPCRA Section 312 requires facilities that use or store a hazardous chemical above a threshold quantity to annually submit their chemical inventory information to off-site officials on or before March 1st of each year. The inventory information must be submitted to the fire department having jurisdiction over thefacility, the respective county LEPC, and the SERC.

Title III Legal References • EPCRA Section 313 (commonly referred to as the Toxic Release Inventory or TRI) requires facilities to complete a Toxic Chemical Release Inventory Form annually for specified chemicals. The form must be submitted to EPA and the State on July 1 and cover releases and other waste management of toxic chemicals that occurred during the preceding calendar year.

  4. Tier II Reporting Procedure • Tier II reports that have been previously required in paper form will now be accepted by an electronic process called E-Plan. • Paper will still be accepted for the 2009 reporting year.

  7. E-PlanWhat is it? • It is free, simple and easy for First Responders and State and Federal users to use. • E-plan operations run 24 hours a day, 7 days a week.

  8. E-PlanHow does it work? • First Responders access facility information through a secure login using an assigned “User ID” and “Password.”

  9. E-PlanHow does it work? • Once logged on, the First Responders have immediate access to all Hazmat information for all facilities in the selected E-Plan area.

  10. E-PlanHow does it work? • This includes information from sources such as: • State Tier II information • MSDS, Chemical Profiles, ERGs • Facility/Building Maps (if available) • Chemical storage locations • Pertinent Web links • EPA, Cameo, GIS Mapping, RRT6, NRT, EPA’s CEPPO, Weather, etc.

How to get access • Go to website at https://erplan.net • Click on sign up for account. • Select User Account type and click on continue to Account creation button to request a User Account. • Fill in required fields. • After approval by authorizing authority in that jurisdiction, the UT Dallas E-Plan Team will set up the new user account and send an e-mail message with the account information to the new E-Plan registered user.
