  15. Health Care • Implementation underway…lots of devils in lots of details • Form 1099 • Burdensome requirement to file Form 1099 for all purchases of products, services totaling >$600 • Votes to repeal or scale back failed in September • Much support for limiting it

  20. H-2A, H-2B • Regulatory chaos • New H-2A regs took effect March 15 but most user growers won’t face them until 2011 season • H-2B proposed rule on wages…would mean substantial cost increase • More rules expected – recruitment, labor protections

  21. Enforcement • Worksite enforcement underway at record pace • More state battles, incl. “Arizona copy-cats” likely

  22. Any Legislative Possibilities? • Lame Duck could see narrow legislative effort including DREAM, AgJOBS • Long odds, but best shot for foreseeable future

  23. A Look Ahead • 112th Congress will be defined by legislative gridlock, positioning for next presidential election • Referendum on role, scope, size of federal government • Progressives are frustrated… • No CIR • No Card Check • No Climate/energy bill

Regulatory Bumps Ahead • Pent up frustration over limited legislative success may lead to unprecedented regulatory activism over next two years • Labor, Environmental, Tax • Given nature of the times, our industry’s challenge will be to work more closely, effectively…or live with the consequences!
