Green Industry Legislative Update NLAE Virtual Fall Conference October 20, 2010 Craig Regelbrugge, ANLA NLAE Virtual Fall Conference October 20, 2010 • NLAE Virtual Fall Conference • October 20, 2010 • Craig Regelbrugge, ANLA • www.ANLA.org Craig Regelbrugge, ANLA
For Today • November Election and 112th Congress • Issues • Small Biz Jobs Bill • Health care • Greening initiatives • Farm Bill • Immigration • Thoughts going forward
Election 2010 • A view from Canada… • House: • D’s 255; R’s 178 • Capture of 39 seats by Republicans to gain control • Charlie Cook expects at least 40 • Senate: • 57 D’s • 2 Ind’s • 41 R’s • R’s projected to gain 7-9 seats
Small Biz Jobs Bill • “Squeaker” led to one more accomplishment • Creation, expansion of various loan programs • Variety of tax, depreciation, capital investment incentives • www.ANLA.org for details
Health Care • Implementation underway…lots of devils in lots of details • Form 1099 • Burdensome requirement to file Form 1099 for all purchases of products, services totaling >$600 • Votes to repeal or scale back failed in September • Much support for limiting it
Greening Initiatives • Green Communities Act (H.R.2222, S.3055) • Leverages green infrastructure public/private partnerships • House hearing late September • Small Biz Environmental Stewardship Act • H.R. 4509, S.3279 • Reauthorizes Small Biz Tree Planting Program • Longer-term positioning ideas
Farm Bill • Specialty Crop title being implemented • Top ANLA/industry priorities • Sec. 10201, 10202 (Plant Pest, Clean Plant Network) • Specialty Crop Block Grants • Tree Assistance Program • Specialty Crop Research Initiative • Biggest threat – BCAP • Look ahead to 2012 Farm Bill
Immigration • Reminder why we are in this… • Status/outlook • Comprehensive immigration reform • H-2A, H-2B • AgJOBS • Enforcement
Stephen “I Packed Corn” Colbert • Humor aside, recent House hearing affirmed politics of the issue • Political environment in 2011/2012 will not support viable CIR effort, and even limited positive measures will be nearly impossible
H-2A, H-2B • Regulatory chaos • New H-2A regs took effect March 15 but most user growers won’t face them until 2011 season • H-2B proposed rule on wages…would mean substantial cost increase • More rules expected – recruitment, labor protections
Enforcement • Worksite enforcement underway at record pace • More state battles, incl. “Arizona copy-cats” likely
Any Legislative Possibilities? • Lame Duck could see narrow legislative effort including DREAM, AgJOBS • Long odds, but best shot for foreseeable future
A Look Ahead • 112th Congress will be defined by legislative gridlock, positioning for next presidential election • Referendum on role, scope, size of federal government • Progressives are frustrated… • No CIR • No Card Check • No Climate/energy bill
Regulatory Bumps Ahead • Pent up frustration over limited legislative success may lead to unprecedented regulatory activism over next two years • Labor, Environmental, Tax • Given nature of the times, our industry’s challenge will be to work more closely, effectively…or live with the consequences!
