TMDL Overview • TMDLs do not create new regulatory requirements but rather rely on existing rules and permit programs for implementation. • Needed point source reductions are implemented through the WPDES permit program. • Non-point source reductions are implemented through: • State required prohibitions and performance standards to reduce runoff (NR 151) • Voluntary, incentive-based actions (various federal and state cost-share and grants are available) • Farmer-led initiatives • County and watershed conservation plans Agenda Item 4A1 Marcia Willhite (Water Evaluation Section Chief)
WI River TMDL • 2009 Legislation and appropriation directed DNR to conduct WI River TMDL Study. • 15% of Wisconsin: • 110 river/stream segments and 38 lakes listed as impaired. • 108 permitted wastewater facilities • Science-based: extensive monitoring, cutting edge modeling • Submitted to USEPA for approval in December 2018 Agenda Item 4A1 Marcia Willhite (Water Evaluation Section Chief)
Public Participation • Met w/agricultural groups, watershed groups and permit holders to participate in TMDL development. • Held 3 preliminary informational meetings and comment period in March/April 2018. • Worked with individual WPDES permittees to understand impact and options • Held official public informational hearing and comment period in August/September 2018. Next Steps • Submitted TDML to EPA in December. 90 day review period. • TMDL includes proposed Site Specific Criteria for three lakes: Castle Rock, Petenwell and Lake Wisconsin (scope approved by NRB at June 2018 meeting). • Once approved, begin working with permitted facilities to discuss compliance options as load allocations are incorporated into permits as they expire over next 5 years. • Compliance options include water quality trading, adaptive management and variance options. • Agricultural non-point sources can utilize edge-of-field targets to compare to current practices—can be a trading partner, AM plan partner Agenda Item 4A1 Marcia Willhite (Water Evaluation Section Chief)
