Regional Law no. 53 dated 6 April 2000 • “Regional regulations governing GMO” • Aims • To promote the actions necessary for preventing risks for human health and the environment deriving from the cultivation, production,and consumption of products containing GMO • Provisions • Ban on cultivation and production of species with the presence of GMO; obligation to label all foodstuffs containing GMO • Ban on serving products containing GMO in collective catering (scholastic, hospital and public regional administration) • Informing and educating of the population with regard to the possible risks deriving from the presence of GMO in foodstuffs and in the environment • Controls and penalties based on the regulations implemented
Implementation regulation of Regional Law 53/2000 • The regulation lays down standards for the application of Regional Law 53/2000, specifying that: • The ban on cultivation concerns herbaceous, shrub, and arboreous crops and the use of GMO seeds • the controlling activity is coordinated by ARSIA and entrusted to: • - ARSIA (Regional Agency for innovation in farming) for farming crops • - ARPAT(Regional Agency for the environment)for seed products • - ASL(Health Departments) for foods • Penalties are foreseen for any violationsand consist of the reimbursement of all contributions received by the proprietor of the farming concern as well as possible administrative penalties

After 7 year’s experience accrued in this sector • Following the signing of the “International Treaty on Plant Genetic Resources for Food and Agriculture” (FAO 2001) approved with Law no. 101 of 06.04.2004 The new Regional Law no. 64 of 16 November 2004, integrating the scientific aims of the previous law with productive and social economic increase
Aims of the new Regional Law • To preserve and protect the heritage of local breeds and varieties from an economic, scientific and social point of view • All local breeds and varieties belong to the natural heritage of interest to farming, animal husbandry and forestry in Tuscany • The Region of Tuscany promotes and guarantees the collective use of the local breeds and varieties through the conservation and security network
THE INSTRUMENTS OF THE NEW LAW Regional Germplasm Bank It is the central unit for all the local breeds and varieties listed in the Regional Repertories. It carries out all the operations necessary for guaranteeing conservation ex situ. They are responsible for conservation on-farm of the local breeds and varieties at risk of extinction listed in the Regional Repertories. They disseminate knowledge and know-how of the local varieties for which they are the custodians. Custodian Farmers Conservation and security network Within the network it is possible to exchange limited quantities of propagation material Follow
THE INSTRUMENTS OF THE NEW LAW This allows for marketing limited quantities of the seeds listed in the repertories that are currently not included in the commercial circuits Regional Register of the varieties for conservation Regional Marking A regional, facultative mark will inform consumers that the produce bearing this identification derives from local varieties at risk of extinction
